    Company is not leaving even after serving 30 days notice period

    I am working in this company from past 2 years as an accountant. I have got good opportunity in one of the good company. In my company the notice period is one month. I had informed my boss about leaving this company and he had promised me to relieve in another 30 days as per company rule. I have finished my notice period but now my boss is not ready to relieve. I have taken time from present company but this company is not relieving me. Please suggest. What action can I take in this case? I don’t want to lose this opportunity

    Hi,

    If you served the notice period you can relieve yourself.

    If the company is not leaving then tell them you will take action.

    Inform the same to your present company so that you wont miss this good opportunity.

    They are suppose to relieve you ,if they are not doing then its their mistake not yours.

    SO,don't worry take your decision boldly.

    Hello,

    FIrst of all, make everything clear with your boss.Try to explain your situation to him.
    Request him to reliese you.

    Tell him that i can continue say 1 week maximum.Whatever work is there complete and without making any issue leave the company.
    And join the new one.He will definitely reliese you.

    Hi.I think your boss is taking undue advantage. you should be firm in your decision and convince him that you have a better opportunity there and you have to go there.

    Be firm and your boss will surely agree. If he still doesnt agree you can give your resignation letter and leave. Then he will realise his mistake and complete the rest of his formalities. or if possible you can complain the HR authorities.

    As you have done your job of serving the notice period well in advance you are in the right and will surely win in this situation.

    So go to your boss and teach him a lesson. Best of luck. Thanx

    You have served 30 days' notice to leave your company as you got better chances to other pvt company.being a permanent employee you should give 60 days notice becausea there are some mandatory formalities are to follow by the present company before releasing permanent employee.

    Company has to fill the vacant post to keep good health of the company.so company has to take resolution before leaving you.

    1. As per company terms and conditions and as per company policy, they should provide you the relieving letter.

    2. As you have said that you have served the notice period of the company and informed your manager prior to leaving the company its your right to ask the manager to give the relieving letter.

    3. If the manager of the company does not provide you the relieving letter then please approach the police so that you can have the justice on your side.


    4. Or else report to NASSCOM so that your problem will be taken care of.

    5. Go to police with the pay slips that you have got with you and also the offer letter and everything that you have got
    relating to the company so that your problem can be solved as soon as possible.

    I understand your situation and feelings. I know, how frustrating is this situation. I recommend you to please talk once more toy your manager, if he understands and take any positive decision. If he still not agree to leave you, then I suggest you to please take this matter to senior management as soon as possible and ask for the proper revealing. If the senior management also denies your application then please make them informed that, you are going through the legal procedure and do the same of the company still doesn't listen you. Apart from this, there are no other solutions. Hope for the best. Where there is a will there is a way.

    Hi,
    As per your explation it is clear that you served your notice period properly. So you can relieved from that company yourself. Explain formally through your mail that notice period got expired so you are leaving organization .
    Before leaving make sure that you doesn't take leave during that notice period. If no leaves taken leave past company. Otherwise compensate number of leaves taken by you i.e. your notice period extends for that many days.

    As you mentioned that you had intimated the company earlier about leaving the company and joining other company and also served the notice period of 30 days, since you had followed the company policy, now it's their duty to relieve you after completing proper document work. If your boss is not ready to relieve you, then you must make him understand your fact politely and try to convince him. If even after that, if he doesn't listen to you, then you must take the legal action. Register a complaint in the court against the company, then they will be liable to relieve you.

    this is very common issue in corporate world. Company want that good workers always work in company,
    while how much salary given by them. This is you pleasure that company don't want to fire you after giving
    the resignation letter. I personally feel that you should not leave the company only for money issue, if you will work in long term for this company ,
    then your responsibilities & your position automatically will be increased.
    But if you feel bad in this company then you can leave with registered notice .

    if your boss is not releasing you even after asking before the notice period then discuss the matter with your boss
    if still this doesnot work out then approach your higher authority and say what problems you have
    and ask them for help
    If you dont want to loose the new job you can ask the HR of the new job to extend the joining date.

    Hi,

    If in your current company the notice period is of 1 month only, and you have served the entire period then they are not having any rights to delay your relieving formalities. For the same you can talk to your HR head, if in case your direct HR is not helping you out.
    If HR Head will not support you, then you can take legal action also against the company, because you have your joining letter with you and in that joining letter it would have been mentioned about the notice period. As you are totally right at your front, then any how you will get the success. You can also initiate the complaint about it on consumer forum.

    Hi..I certainly think you shouldnt lose this opportunity of your new job which will surely help you in your future and is going to benefit you surely..So you should certainly take some action against your previous company..

    Firstly check that you have completed all the formalities regarding leaving of your job by checking the policies of you company..If you have done so then go and talk to your HR manager telling him that you have served your notice period and now want your experience letter as you want to join your new job as soon as possible..

    I am sure your HR will help you and you will get what you deserve..In the worst circumstances if he doesnt do anything then you leave this job and fiie a complaint against your company and sue them..

    Congratulate to get new job with another company! Definitely you should go for your new job opportunity even your boss is not relieving you from the job. Because you have completed company's terms and conditions. IF your boss is not relieving you from the job you can feel free ask about your salary if they hike your salary around new company's salary. So as far as I think that there is no need to go for new job offer, because you already working with this from long time and you know very well every one of your company employee. So you can take decision of your choice whatever you can think best for your bright feature.

    1)first of all go and ask your hr for regarding this issue why they are not giving notice period

    2)he will clearly explain what is what and why they are not giving

    3)that may be you have good knowledge in that company

    first of all,leave the job as per company norms.

    before leaving the ask HR to why they are not providing the notice period to you

    may be company will not loose you

    may be company will provide the better offer than the that company

    may company think in a that way

    the company never loose the best employees.
