    Will the employer pay if he/she terminate someone and donít get job for some time?

    One of my co-employees got terminated due to new conditions of organisational chart of company. He has not got job for 3 months. And when asked for compensating for the above months, the employer denied. Can it be possible legally? Please suggest.

    I dont think that your employer is required to pay you the compensation for not having any job once you are terminated. Once you are terminated, whatever the reason might be, or you resign and leave the company; you cease to be the employee of the company and thus the company has no responsibility towards you or your salary. Thus you should tell your co-employee that he should try to search harder for a job and not depend upon his previous company to compensate him for not getting any job.

    Now such terminations are very common and it does not mean that the company owners will compensate for such terminations if the employees dont get another job. so tell your co-employee that he should search various newspapers and other publications of repute to find a good job according to his needs. Also internet is a very usefulmedium today especially naukri.com. He should make his resume through a professional and prepare well for the interview part. I am sure if he follows all the steps he will have no problem in getting a decent job.

    Dear Friend!

    Its not a company problem if any co-employee is terminated by the company and don't get jobs anywhere. Company is not responsible to provide terminated employee for any compensation in any way, even not a legally. Please suggest your friend to find out jobs asap and don't expect for any compensation from previous company.

    Hello !!

    there is something difficult situation here,
    your company first terminated your employee and then asked him for the compensation for the vaccant month.
    so this is not done favour by the company so, if the employee has disagreed than company have no right to take any legal action on him.
    because now he not the part of the company.

    so,no action can be taken on him.

    Hello !!

    yes, what the employer did can not be taken into action, because now he is not an employee but he is a common man for the company.
    since, he is not working in the company therefore company has no right to take any action against him.
    also, company has only terminated the employee.
    so no question for any compensation from the employee side.

    so taking action on the employee is not legally possible.

    Hi.............,

    What can you do--->
    * You did not mentioned that your employee had signed some contract or not.
    * If some contract is bounding him then you can not claim.
    * Know the exact reason of termination.
    * If you think that employee is terminated without any payment of compensation if he deserve then opt for legal actions.
    * Legally you can challenge the company in court.

    Dear Aspirant,

    It is not a good news to hear.You may be aware that the payment to the employees are paid against the duty.If one employee works for a period of 30 days or for a month,then he/she is paid salary for the concerned month.The employee is paid salary for the leave period,if he/she has it in credit & avails it.But after termination or resignation,the employee is not entitle to get the pay.

    If your co-employee has been terminated without following the terms & conditions of the appointment order i.e without giving the notice period,the employee should have been paid the payment for the notice period as per the terms & conditions of the appointment.The notice period varies from one month to three months.

    So see whether the terms & conditions have been followed by the employer for termination.If not your co-employee can claim it legally for compensation.Also to get regular pay,he must get a new job.

    yes company will give give 3 -5 months salary in advance if your removed from service and when you have served for the company for a period of time... atleast 3 years,this is usually given for allowing you to search for another job...

    Hi friend

    I dont thinkyour employer is likely to pay you any compensation as your friend didnt get ajob after being terminated . He was teminated due to unfortunate circumstances and I am sure your company didn't do it on purpose. Now its your friend's fault that he could not find a job after that. Ofcourse maybe he has to face some bad circumstances due tio which he was forced to not get a job. But that is not your company's fault and thus it is not liable to pay your friend ANY compensation.

    Tell your friend to employ every ,ean possible to finsd ajob and you also try to help him out. Search the newspapers and the internetr which are the two best sources for finding a good job. Also try other means as well and dont restrict yourself to any particular one. Rather than criticizing your company for terminating him , you should help himm in this troublesome time.

    Dear friend,

    An emplyer has full rights to terminate the services of an employee provided the employees doesnt satisfy the requirements of the JOB. In case he is not eligibel or breaks the rules of the company, He can be terminated legally. in no case the company is liable to pay for the loss he is bearing or pay him until unless he gets another job.

    I would suggest your friend not to show to any company the work experience for the company he has been terminated from. this will give a blow to his career as many companies dont find it suitable to employ someone who has been terminated from his last job. Its ok to show a gap and give some personal reasons for it.
