    What should we do with the employee who was absconding for almost 1 month and then came back and applied for the resignation?

    We had one of the employees who took a leave for 2 days for his brothers marriage. It was almost 2 week and this employee did not come back. We taught of sending him warning letter if he does not come back within a month. He came back after one month and applied for resignation. Should we accept his resignation or should we take legal action against him? Please suggest.

    You should Not ACCEPT his resignation.

    I presume that he must have taken leave to search for jobs and once he got the job, he came to resign.
    You should also refer to your Company HR ploicy which must be documented and take action as per that only.

    You should staraight away tell him that his resignation cannot be accepted.

    Also if joins another company and that company HR calls you for verification, than also you can tell the whole truth as to this employee took unapproved leaves and than came back after one month to resign.

    You cannot take any legal action against him, as he has not done any crime for which leagal action has to be taken.

    Hi

    as per my knowladge no other company will accept his resignation

    after watching his behaviour.

    coz its wrong if you take 2days leave and not come after a two weeks latter.

    and a monthe letter you came for resignation.

    its totaly wrong its unprofessional.

    so i suggest you to not to accept his resignation.

    Dear Aspirant,

    since the concerned employee is not interested to work in your organisation,it is better to accept his resignation on the basis of terms & conditions of the appointment.If he was supposed to give notice period & he has not given it in the case cited,the amount of money in lieu of the notice period may be taken in cash or it may be adjusted with his financial accounts.

    Instead of accepting his resignation,If you starts to take action,Both of you may be disturbed because the concerned employee too can show a proof of urgency to be on leave for the said period.

    So It will be better to accept the resignation & settle the accounts.

    Dear friend,

    After reading this issue, I think it would not be good if you dont accept his resignation but yes you can ask him to serve the notice period and count his leaves as unpaid leaves. but before accepting his resignation I would suggest you to take his one on one and ask the reason for leaving, if you find his reasons to be the valid one then accept his leave.

    sir/madam..When an employee goes under leave for the purpose of brother's marriage or else.And do not think to join his/her duty after finishing the occasion.Then company can send notice for joining as the company suffers staff shortages.Yet the employee can not come then what kind of action a company can take.

    1.Company must not terminate him/her from service.

    2. If the employee exhaust all sorts of leaves then company can send a notice informing him about his leave position and her/his salary may not be done as he/she have no leave balance,so your deduction of salary will start from next month.
