    What should I do if my organization does not relieve after serving 30 days of notice period?

    I had joined to software company as HR executive for salary of 4500/- month on one year of contract basis. I had finished my contract and my salary was increased. But that was not enough for my livelihood. I had got opportunity in a big organization and applied for resignation in this company. I served 30 days of notice period but my previous company did not relieve me nor did it give the salary for 30 days. Hopefully I got in a new company, but i feel as if my one year experience is wasted. I wanted to get the experience letter for this company. Please suggest how to get it.

    Hi,


    Certain people will face this kind of problems

    Nothing to worry about this

    If you have signed and agreement and it got expired , no problem at all

    You have given notice period and its completely company resposnsibility

    To handover experience certificate and arrears amount

    Report to your HR and talk to higher management

    Surely this problem will be solved else

    Report to NASSCOM or Police dept to sort out this problem

    In the present company don't tell this problem that will lead to termination

    In your Case as now you ahve already joined your new company.
    You can use you Salary slips and appointment letter of your Previous company to show your experience.
    These two things will suffice the experience part.

    Now you can approach your previous company and talk to senior manager and ask them for the experience letter.
    You need to tell them that you have worked in this company as per the rules of the company and while leaving the organization, you served the required 30 days notice period.
    So you should be given the experience certificate as well as the salary for thsoe 30 days

    Dear friend,

    I would suggest you to first write a written application to your HR dept of previous company and take a xerox copy of that asking for a reply.
    If you do not get any proper satisfactory reply by the concern authorities you can file a case in labor court of your area with enclosing all the necessary documents i.e, Appointment letter, contract letter, resignation letter and application . You will surely get judgement on your favor need not to worry as it is completely illegal and comes under employee molestation.

    Hi,

    If you have served the entire period that is of only 1 month then they can not force you anyhow to stay more in the company.They can not even delay your relieving formalities. Regarding this matter you can talk to your HR head, if in case your direct HR to whom you contact in general if you have any problem is not helping you out.
    If even HR Head will not listen you and support you, then in that case you can take a legal action also against the organization, because you have all your documents like your joining letter with you and the same will be containing all the information about the notice period. As you are totally correct at your end, then no one can beat you will do something against them. You can also write the complaint about it on consumer forum.

    Hi.. I certainly think that you have the right to get your experience letter from your previous company as have you worked there for one whole year according to their terms and conditions and now its certainly not fair that you dont get your experience letter after such hard work and effort..

    First of all you should see your company's policies properly and check whether you have completed all the formalities of resigning from your company ..If as you say you have completed all the formalities and also served the complete notice period then you should go to the office of your previous company and talk to the HR regarding this matter and that you want your experience letter soon otherwise warn them that you will file a complaint against them for such injustice..

    You have the Right to get your experience letter from your previous company as you have worked there for one year .
    According to the terms and conditions now it is certainly not fair that you dont get your experience letter after such a hard work
    Check the Company policies , rules and regulations , and check that you have completed all the required formalities of resigning from
    your company. if you have completed all the formalities and also served the complete notice period then go to the previous company
    and talk to the HR regarding this matter and that you want your experience letter soon ,
    if in case then warn or file a complaint against the injustice
    They will surely respond for this....

    Hello Friend,
    As you have served the notice period then they cant stop you,before taking any action i suggest just check whether its all ok from your side or not,like you have got clearance from all departments(Provident fund,transport,library....etc).you have served the notice period as per the company policy.if its all OK from your side then you can ask firmly from to your management for the release ,if they dont listen then you can complain to the HR Spock ,he will definitely take care of the matter and resolve the issue.
    else dont wait for the company to give you release ,leave the job join the other company and file a case against your previous company for not adhering to the policy which they had formulated.and yes you can claim for the last month salary also.
