    What should I do if my organization does not pay the bonus component mentioned in offer letter?

    I have had joined an MNC one year back and upon the completion of one year the company has not paid me the bonus component mentioned in my offer letter. When I contacted my HR department didnít got any satisfactory reply. Please guide. Could I file a legal suit against the company.

    Hello,

    In the case of bonus component one should always be thorough with there CTC.

    Many a times the bonus components consist of 2 parts.

    1.A fixed bonus.
    2.A variable.

    There is also a gratuty amount which is paid to you after certain period of time.

    So if you havnt got your bonus than first of all check it with your colleagues if they have got it .

    If its only you than you can write a complaint letter and send it to the higher ups.

    Hopefully they will respond.

    If they show less interest than you can take this matter to court.

    But the last option should be the last option cause its not easy to be in a company on which you have lodged complaint.

    Hi,
    It depends on company norms.They may promise you certain percentage of basic pay as bonus or they may put clause like based on performance it will vary.

    Go through offer letter and it is fixed means contact HR or finance department.Otherwise improve performance this year.

    There are two type of bonus, one is based on the company's performance and the other is based on your performance.
    The company performance bonus is same for all the employees but the variable bonus for the individual is different depending upon the rating of the employee.
    The rating is done half yearly or once in a year if your performance is good then you will get the full bonus amount.
    if your rating is low then you wont get the bonus amount.
    There is nothing you can do against the company, if those are the norms of the company.

    Dear, friend if you are worried about your bonus which you get after one year of completiton so, first of all you should go to your HR.manager and tell about the bonus offer made in appointment letter.secondly you should checked your co-workers about this if they had received then you can asked for your bonus from authorities . And lastly some company give bonus only if the company have made huge amount of profits, even they make promise.you should check this before going to to HR.

    Dear, friend you can complain to hr manager about the bonus mentioned in the offer letter or you can also chech other co-workers if they are getting the bonus then you are also eligible for bonus.some company give bonus at the fixed time you should also check this.

    As you have joined the company 1 year before and you are not receiving any bonus from the company which is mentioned in your offer letter, so I suggest you to please submit application to higher authority in the company regarding this issue. I am sure they will surely entertain your request. You can also reach you colleagues regarding this issue, but did not let yourself down if they are not interested in this issue. However if the higher authority in the company not entertained your request then I suggest you to please file a case in RTI or any legal jurisdiction, which handles all these issues. But remember its very difficult to continue in the same company after filing case against it, so think twice and take your decisions.

    Actually the companies mention performance bonus component in offer letter(by considering the company performance of the financial year +your performance in the year) as percentage depends on your package some 15-20% of basic like that.It's totally depends on your performance,rating you got in the last year.Moreover it depends on your manager.They will decide the % depends on your rating and the comments given by your teamlead.So we can not do anything in this.you need to talk with your manager about this issue.If all your collegues got the bonus and your or not then meet your manager and discuss with him about this.On what criteria he is giving bonus like that.


    If you are talking about joining bonus,in that case bonus amount what they mentioned in offerletter company needs to pay for every employee.So you can directly ask the HR about this and you have every right to proceed leggaly also.

    So I will suggest you better to please submit application to higher authority in the company regarding this issue. I am sure they will surely entertain your request...and show your offer letter also that sir when i join the company they told and mention in my resume also...first talk to all higher post member in your company..if they will ignore and you have proper proof then you can go for legal suit against the company...

    Yes you can complain to a higher authority about this but no need to take a legal action. Its your companies reputation at stake. If you were promised a bonus and you didnt get it contact with your colleagues if they have got any or not. If they have and you havent then you can complain to the concerned department.

    Else all of can write your name on a email and share your problems with a higher authority if your hr doesnt give you a satisfactory answer.

    Be sure that you are right about what you are doing else you might face a problem in the future.

    Hi guest, Bonus is paid according to certain percentage of your salary or it is paid basis on your performance in the year. So you must have to check your offer letter again. You must ask all the other employees if they have received the bonus are not , if they haven't received the bonus then all employees must together contact the HR of the company and demand the bonus.     You case file in against company and you talk HR if you

    help something and another option only File case and

    mostly company not returns this type bonus only

    pay salary based plus bonus your perfomance based.

    You are a good employee if you get bonus easily

    and other option you legal against file and get bonus.

    See you need to follow the proper channels available in your company to get the answer to your query
    Just do not rush to file the legal suit

    You should first contact your reporting boss and show him the offer letter and ask him to help you to get the bunus if you meet all the eligibilty

    If he does not help than you can go the next level .
    if both your bosses dont help you than you can approach the HR manager of your company with your request

    If they also dont help you than you can approach the CEO or MD of your comapny

    Also make sure that you should always put your query and requests through your official email id so that proper records is there
    before speaking with anyone, put a mail across

    Hi. First of all you should check your offer letter again and see what type of bonus it is and how and when it has to be paid.

    Once these things are clear to you and then you feel that you have been not given the bonus in time then you can first contact the higher authorities.

    As you have already told that HR dept is not giving a satisfactory response try to talk to them directly if possible and get a solution.

    If still no solution is reached then you can surely file a legal suit against the company.

    Hello friend,
    the bonus component mention in your offer letter is your right and nobody can stop that.and manger does not process that the finance department process that.
    you need to confirm that whether they provide that every month or once in a year because this policy varies from company to company.
    else if you have any doubt then go to your finance department with your salary slip they will describe why you are not getting your bonus and when you will be eligible for that.

    Your are not supposed to do any legal claim for the company.

    Some companies will mention the performance bonus amount in the offer letter.

    I think some of the reasons for not getting the mentioned amount is

    -you might not have completed one year in the organization
    -your performance may not be good.
    -you might have spent most of the months in training only.

    I think all these things might be discussed in your appraisal.

    Better contact your manager and then HR.
