    What should I do if the employer hold the salary of notice period?

    I was given notice period of 2 months after I gave my resignation letter and during that time I found one more job and left the company after 40 days which in sense I didnít complete the notice period fully and now the employer is holding the salary for that 2 months. What should I do now? How to get the salary for those two months? Whom should I contact to resolve this issue?

    Hi..I think that it is certainly your fault that you didnt follow the proper procedure of resigning from your company and thus now you have to face such problems..You should not have left your company before serving the complete notice period ..Your employer has every right to punish you for the same and thus he is withholding your salary maybe as compensation for your fault..

    When you got your new job you should have told your new employers that firstly you have to complete your notice period and then only you will join the job..But if they were forcing you you to join immediately you should have talked to youir previous company to reduce your notice period and that you are ready to pay fine..

    But as you didnt do anything now you cant do much about it..Best thing you can do is go to your previous employer and talk to the HR dept regarding..They will certainly provide you with a solutin..

    Dear Aspirant,

    It seems you have violated the terms & conditions of your appointment in the company.You must know that the purpose of notice period is to settle all financial accounts of out going employees.

    Since after giving the notice period,you could not complete it,you are not entitle to get the full pay of the 2nd month.

    In this case you are advised to see the terms & conditions of your appointment & you have to follow it to get your resignation accepted in order to get your experience certificate & settlement of your accounts.If you are not able to work for the notice period,you should deposit the amount in lieu of it otherwise you need not expect any experience certificate & your accounts settlement.

    Hi aspirant

    Contact the HR of your previous company to resolve this issue. You should have not been in such a haste earlier on so as to leave your company without serving your full notice period . You should have talked to your manager before and he may have helped you in resolving the issue. To do something in haste is never good and i think now you have learnt this lesson.

    So now even if you dont get your 2 months salary you should not regret it as the fault is yours and not of your company as they are holding your salary for genuine reasons. Talk to your HR and tell him why you left the company just after 40 days. He may or may not give your salary to you as a compensation for your breaking of rules. But atleast get your experience letter which will be of help to you in future.
