    What should be done with a female employee who wants to avail her maternity leave just after 3 weeks of joining?

    I am the manager of a private firm. One of the female employees, who has recently joined the company is asking for her maternity leave just after 3 weeks of joining. I have told her many times that it is against the company rules but she is still insisting. What should be done in such a situation?

    You should have checked about it while recruiting. You should properly check with terms and conditions of the job offer and if there is no such provision to give maternity leave so soon then you may deny it but if there is any provision to give then you may consider it.

    I think it will be a very critical decision to make and you should not decide it alone.

    Better will be to consult your HR department on this issue and then only take any decision. HR department will be in much better condition to decide about whether to give her the maternity leave or not.

    If you don't give her maternity leave and she can't afford to work. Then in this case, she may well resign. So, you need to think on all the aspects before coming to any conclusion.

    If the rules of the company does not allow to give maternity leaves to employees who have just completed one month you cannot give
    Even if she is insisting you can just say her that Leaves cannot be granted as per the rules
    If she is in urgent requirement for leave than she can go leave without pay with approval of senior managers
    Last option would be to leave the job
    It may be a case that she may have joined the company with an intention to work for one month and than take 3 months maternity leave

    The employees will definitely demand to fulfill their requirements.But you can not go against rule.You can ask to go on leave without pay.As per the maternity Benefit Act 1961,the concerned employee should work for at least 80 days in a calender year to take the maternity leave & she should give 4 weeks notice in advance along with the medical certificate to avail such leave.

    In this case you can ask her to give it in writing & forward the same with a recommendation for necessary action to the administrative section.Let them study the rules & do as per it.Meanwhile ask the employee to proceed fro the awaited work,because the delivery of birth is more important than the service matters.Console her & wish to take care of the expected baby along with herself.

    There is nothing much you can do. If your company does not permit you
    to exercise maternity leave option for some one with only three months
    of work experience then you should tell her clearly. Each company has
    their own set of rules and regulation and you have to maintina that. If
    you make an exception in this regard then someone will take advantage
    in the near future. You have to talk to their higher authorities about it.
    In general maternity leave is allowed in this cases.

    as it is a difficult situation but as a manager you should think about it so that the work load given to her should be distributed among your staff if she takes leave.
    as she is not asking for any ordinary leave she is having a valid and strong reason,so my suggestion is to grant her leave because these moments cannot get for a mother always.

    As the maternity leave is to be provided to an employee whenever he/she gets married, therefore joining of her term should not be an issue of not providing her the leave. You should provide her the leave and you and your staff should also go into her marriage and enjoy for sometime because these are the one time life events and everyone should be happy while joining it.
    Hence you should provide her the leave.

    i think u need to ask to provide the medical certificate as a proof then u go as per the rule of your company dear. because she is very new to your office so if u see that the case is genuine then you can leave her for short period of time.
