    What to do if I am being charged of disciplinary actions for exceeding the limits of medical leave?

    I am working in home depot services. I am suffering from filaria. I expected it to be cured within 3 months, So I had provided a medical leave certificate verified by Family and Medical Leave Act which has a validity of 3 months. It is already 3 plus months and I am still not cured from the disease. Yesterday I received a letter from the company and they have threatened disciplinary action will be taken against me. Is there any possible means to avoid such unwanted circumstances?

    As you have already taken a leave of 3 months it is not to get more leaves for you.But disease is not yet cured.the office is going to take a disciplinary action.so, consult HR office for more leaves and also inform that you wont take any more leaves after curing the disease.you also tell them that it is a very serious disease and i am cannot able to attend the office tell very carefully.take good treatment and be a healthy person.

    As it is a genuine reason that you are suffering from a disease that doesn't have a fixed time period for being completely cured you must communicate this matter to the company. As it is a medical thing you must have to show the reason of your extension of leave. For that you must consult your doctor and try to have some certificate regarding your extension of leave mentioning the reason for extension. See the company is working according to the information they have. As you previously asked for 3 months leave so after completion they will definitely take some action as they have the right to do it.

    So it is your duty to inform them about your latest condition and also the reason that why you were not able to get back to the job. Also try to find out with your doctor the time you will need to get back to healthy state so that you can be more clear while talking to the company about your condition. As they will definitely ask you about the time you will need to get through this state and get back to work.

    you should inform to your Hr Manager prior about your health condition and then have to prove the same with medical certificate given by concerned doctor being treated and request him for further sick leave as per your doctor's advise.The Hr Manager should sanction your further leave first, then you are eligible to utilize the leave even on loss of pay as per the rules of the company.On humanitarian grounds company may sanction your further leave if proved it is genuine and chronic disease case.Each company sets a limit on number of leaves, within the set limit every employee have to avail the leave and they get counted as PAID LEAVE.

    Regarding your sick leave if submitted late, you would have to prove to your superiors that you did phone and emailed earlier about your leave. If not informed earlier they may take disciplinary action as per the rules of the company.
