    What action can be taken against the employee who has not completed her notice period and stole money from the company?

    We had one employee called Rachna who had joined the company 6 months back. She wanted to resign from this job because of some personal problem. She did not complete her notice period of 2 months and instead stole Rs.50000 company money and ran off. What action can be taken against her for doing this mistake?

    First thing is that you need to contact that employee and ask for the reasons of not serving the Notice period.
    Also ask her as to why she stole Rs 50,000 from the company.
    Ash her to return the money or face actions.
    If she returns the Money, than you can settle the issue there only.

    But in case is she is not ready to return the Money or is not traceable at the address given to you at the time of joining than you need to Register a Police Complaint against Her.
    This is a pure case of theft.
    Let Police take action on this issue.

    If she had only left the company without serving the notice period and not stealing the money than there was nothing you could have done apart from not issuing her the experience certificate and giving her pending dues if any.

    Dear Friend

    This is surely a case of theft you should immediately go to the management ask them toi lodge a FIR of Theft against he Employee..

    Provide police with all the details that the company has it will help them to arrest them and return the money back to the company..

    If she had not stolen the money then there will be no issue as the experience certificate will not be provided to her..

    The documents kept the company should be handed over to the police to help in the investigation..

    THis was a bad experience in the company..

    ALL THE BEST FOR HE FUTURE..

    Dear, asker it is the case of police just like she had made fraud with company. One thing the company should had done before left her when she want to left the job, she may have some serious problem. But now the company can lodge FIR against her for stolen money. But if she return with money the company can forgive her and terminate her. But it is necessary for every company before recruiting to any staff to have a look over their background.

    Dear Aspirant,

    It is very bad to hear such a ugly thing.You must immediately contact her over phone & sent a registerd letter stating to return the money within the time given by you ,say for 10 days.If you don't get proper response,you can lodge a police case.The matter will be enquired by the police.But before doing such thing you must have evidence & proof for stealing the said amount.I don't think you can proof the matter with proof & evidence.So think well over these things before lodging the police case.

    If you are not able to give evidence & proof,better not to go to police station.Just contact her by correspondence & see the result.You can also adjust the money through adjustment of her financial accounts,if any pending with the company.

    • Firstly collect all kind of evidence in order to prove that the she had thefted the money.
    • If she tracable, call her to the office and ask if any other employee has supported her for doing this crime.
    • You need to seize all his original documents.
    • If she was appointed from any recommendations, contact that person who recommended, ask him to compensate for the loss incurred by the company.
    • Register a complaint in the nearest police station against her for theft of money and produce all the evidence.
    • If she has deposited any kind of security amount, you must have to forfeit it.

    Dear sir/madam-According to statement it indicates the lady is a thief and a company rule breaker.So company can take steps against her.

    1.A FIR to be to be done nearest Police Station informing the fact of money stealing against the employee.

    2.As the employee did not serve the notice before leaving the company a notice should be sent to her immediately.

    3.And she will never get experience/skill/character certiificate from the previous company.

    not comleting a notice period is not crime

    but stole companys money is a crime.

    so you can do only one thing you can leunch a file aginst her.

    but make sure that money was stolen by her.

    otherwise she will get affected if dhe is not the theaf.

    so first confirm and then do the things.
