    Shall I give part of revenue to my partner when he has only invested but profit made by me?

    Me and my partner have opened a consultancy firm in which he and I have invested the capital but he is much concerned about his own personal business and I am indulged in this partnership business in which we had decided to share the revenue but if he has not contributed any physical efforts in this, can I claim not to share any revenues with him?

    Hi..................,

    If you made a deed then
    * Must share equal profit if sharing ratio not mentioned.
    * Must work as per profit sharing ratio if mentioned.

    In case of no deed ----->
    * Profit sharing depends on capital invested.
    * Profit sharing also depends on active participation of partner.
    * And law says that in absence of deed profit need to share equally.

    Hi Friend,
    Your dilemma is understandable. However, there are certain things that you need to consider and remember.

    Partnership is basically an agreement between two or more persons to share the profits and losses of the business carried on by all of them or any of them acting for all and each partner contributes respective capital . In your case, even though your partner does noy pay much attention to this business and you are responsible for the profits earned but you are bound to share these profits with your partner by virtue of this partnership agreement between you two.

    I think it would also be good if you once discuss with your partner that he should devote atleast some time and effort on this business also rather than his other personal business so that he knows that you are not liking this act of his.
    This might help you in making joint efforts to earn profits and then you will not mind sharing the revenues with him in that case.

    Hi aspirant

    In my opinion if both you have invested have invested the capital in this business then you both will receive the profits from kit and thus you are bound to share the profit with your partner as you yourself haven't made all the investment. If you have signed the partnership contract with him then you can't back out now and take all the profit by yourself. Rather you should tell him to give more attention to this business rather concentrating on other things.

    Tell him that as both of you have invested the capital in this consultancy business, he should start taking more interest in it from now on so that he rightfully deserves the profit earned from his hard work and not just by virtue of the contract between them. You really hope that he will be more physically present in this project from now on so that you are not overburdened and thus are helped by him in the time of need.

    hello,
    i think you should share the revenues you got . this is because when you started your firm, he also invested in that.
    without his support you might not have started this firm. so you should happily share the revenues earned.
    and next time if you are pretty sure that you will have good revenues next time also then just clear the things out about your friends share for the next revenues. in this your friendship will also wont get harmed and you would also get complete revenue next time.

    Hello,As you are involved in a partnership business profit and loss both will be shared by each other in certain ratio..But you should make clear about which kind of partnership deed you both have agreed upon..And depending upon that you can share your profit..Thank you..
