    Senior manager has filed a case against the company for payment of work done here

    Our Company has incurred a loss because of one of the senior manager. Higher up gave him a warning and left him. After few days the loss incurred found to be too huge and higher ups immediately terminated the senior manager without any prior notice. Now the senior manager has filed a case against the company to get the salary for the days she worked. As an HR what should I do in this case?

    If you have proof stating that the senior manager was responsible for incurring losses to the company, then the company has the right to terminate the employee's service. Put it this way, inform her that the salary for the days she worked with the company cannot be given to her because the company incurred losses due to her fault and that salary will be charged as the cost for restructuring the company's losses. Let her know that the company can even go to the extend of making her compensate for the losses if further decisions are agreed upon.
    Don't make it a personal issue, you should discuss the matter with the higher authority of the company. The decision should not be yours alone, take the opinion of the authority too.

    Hi. As the fault here was that of the Senior manager, you should not let her get a upper hand on you and thus as an HR see to it that your company doesnt have to pay anything unnecessary to the senior manager. As an HR it is your duty to protect your company and safeguard it against such frauds. So you should make sure that the senior manager doesnt get anything more than what she deserves plus is also punished for her wrongdoing.

    So firstly as you have given her a warning before also, thus it means there was some reason behind your terminating her services immediately and you should use this thing to your advantage. Dont let her win the case at any cost. Prove to the court that you have given her a warning beforehand but she did not pay any heed to it..She made the company suffer from heavy losses and thus the management was forced to immediately terminate her services. Earlier also she did the same thing but was just given a warning and left but now as the consequences of her act were severe she had to be terminated immediately. So she certainly doesnt deserve any extra salary as she has already harmed the company so much. Rather the company should claim compensation from her.
