    Provision of Paternity leaves in corporates?

    When Maternity leave exists then Paternity leaves also. Is there any law or procedure of Paternity leave in corporates? I have heard that it can be availed for 7 days? Please provide detailed information for this.

    Hi sir,

    yes, Maternity and paternity both leaves are available in corporate sector as well as in government sector.But it differ from company to company.

    There is no law stating that Paternity leave should be given to an employee, but many big corporate are giving up to one week paid leave as paternity leave. It is different for many organisations. Unlike Maternity leave there is no hard and fast rule for Paternity leave.

    In government sector :
    female employees are entitled to maternity leave for a period of 180 days for their first two live born children.
    male employee (including an apprentice and probationer) with less than two surviving children for a period of 15 days to take care of his wife and new born child.

    In corporate Sector :

    .Every female employees shall be entitled to Maternity leave for a period not exceeding 12weeks (6 weeks before delivery and 6 weeks after delivery) after she has worked for a period of not less than 80 days in the 12 months immediately preceding the date of her expected delivery.

    Every male employees shall be entitled to paternity leave for a period of 5 days to 1 week depends on company without loss of pay.you can exceed some days but it's totally depends on the managers or HR decision.

    Dear friend,

    many companies dont allow paternity leaves.
    Some companies do provide but it is just for a week.

    There is a provision for taking loss of Pay leave after citing reasons for the leave.
    Most companies are considerate and they do provide leaves.

    You can take leaves during board exams of your child.
    But in all cases to avail such kind of leaves you must have completed atleast 80 working days in the company.

    Dear friend,

    Let me tell you one thing first, there is no separate clause for paternity leave in labor laws like maternity leave.
    But yes people get paternity leave too in corporate but it all depend on the HR policies of the company where you work .

    Some companies do have provisions of paternity leave in their HR policies and few do not have , but most of the companies generally have provision of paternity leave .
    Generally a person gets 5 to 7 days paid leave as a paternity leave at the time of birth of his new born baby, this duration of 5 to 7 days may get increased in case of any emergency occurs, but yes again it depend in which company you work and its HR policies.

    What you have heard is totally correct.There is a provision of 7 days paternity leave in the corporate under the conditions that the husband of a pregnant wife must be cohabitant at the time of birth of the child,the father must be the employee of the company at the time of birth of new child,father is a legal husband of the child mother,he has applied for such leave within the reasonable time of expected date of delivery.You can avail for maximum of first four delivery of your legal wife.

    Sir/Madam-every employee of a company is entitled to enjoy paternity leave when he is going to be a legal father for a new born baby.An employee can take 7 days' paternity leave for the purpose.An employee belong to pvt company can enjoy 4 times this paternity leaves in a life time service.
