    No maternity leave being given as I am amidst a very important project

    I am working in a software company. I am 6 months pregnant and thus want to avail my maternity leave now as I feeling a lot of stress now-a-days. But my manager is not allowing me to take the maternity leave as I am in the midst of a very important project. I donít think this is fair. What to do in this situation?

    Hi friend

    Your manager should be mature enough to understand your problem and should definitely allow you to take your maternity leave.He should realise that if his wife was in your position , then would he behave in the same manner with her and not let her avail her maternity leave. I am sure the answer is no. Once he realises this then I am sure he will have no problem in providing you with a maternity leave. You are the one who has to make him understand your problem and the only solution to it.

    Talk to him again and this time make it sure that you are able to persuade him. Tell him that you are 6 months pregnant and thus have to avail your maternity leave now as advised by your doctor and also as per the rules of the Maternity Act. He has no right to stop you or not sanction your leave and if he does so, you will be forced to complain to the police or the higher officials. You really hope that he realise what all problems you are going through right now and if it was his wife in your place you are sure he would have given her the leave.

    I am sure your manager will feel ashamed of himself and thus will not force you to stay in the company during your pregnancy anymore.Congratulations friend and hope you have a healthy and safe delivery. Good luck

    Hello Mam,
    A project does not run on a single person there must be some backups for every project,may be you are the critical resource for that project but in this situation your health is much more important than the project and nobody will responsible if something bad happens with you.so give priority to your health and apply for leave.if your manager insist you to stay then ask him that you will communicate every minute details to the secondary whop will be available at that time and you will be available over phone to assist him.
    if possible you can work from home for the initial couple of weeks if allowed.maternity leave is a special type of leave and manager have no right to deny you that at max he can request you to spend couple of more days without taking leave but if you find it uncomfortable for you to attain office then you should take it.After all health is wealth.

    Hello Aspirant,

    Really it is not fair.You should not wait for your maturnity leave approval,because it is a matter of life saving.Apply your leave & get a receipt for it & enter on your maternity leave.Get a medical certificate which advises you to be on rest.You can avail maternity leave for 12 weeks i.e 6 weeks prior to the expected date of delivery & remainig 6 weeks after the date of delivery.You are entitle to avail the maternity leave with full pay.After expiry of your leave,join duty with a medical fitness cerficate.

    If you face any problem by the management,you can take legal help,because the maternity leave is governed by the maternity benifit Act a961 passed by the central govt.

    So,you need not worry for company works now.It can be looked after by others also.
