Maternity leave being put on hold

I am working in a software company from the past 5 years. Recently our company made an announcement that for the next 1 month no one would be granted any leave, whatsoever the reason maybe. This is due to a very important project going on which is very crucial for the companyís future. But I urgently wanted to avail my maternity leave right now due to health concern. How should I proceed in this case so that I donít lose my job?

    Hello ,
Health of a employee is of atmost impoartance and in your case it is health of your child as well .
You should be extra carefull and should not hesitate in applying for a maternity leave .
You can avail a total 12 weeks of maternity leave --
--> 6 weeks before you are expectin and
--> 6 weeks after the delivery of your child .

while those 6 weeks before expecting , you can demand for some light office work rather than you mention
a very important project of your company , You cannot support that much stress .
You may want to be a part of the project , but it is not advisable .

The company has announced this news so that people dont cmoe up with les important leaves
such as -- vacation . I am sure if some thing comes up which demands a leave , the manager surely understands.

IN your case , you will be risking a lot which is just not appropriate .
    • There is no question of your job threatening , you are entitled for your maternity leave when required

I am sure that your manager will be please to grant you the leave . You been working for the company for 5 years ,
can surely take the benefits as well .

    All the very best .
    thank you !

    Hi friend

I think at this stage of your life, you should forget about your job and try and give your best to your health. You should take proper care of yourself and your baby at this stage of your pregnancy. You should not take any stress at all and should not overburden yourself with any work stress at all. You should eat heathy and according to the advice of your doctor. Take proper rest and thus take proper care of yourself and I am sure your family members will help you in this matter.

As for your company not allowing you to take any leave for the next 1 month, I think they have no right to do so even though an important project is going on which as you say, is very crucial for the company's future. But whatever the reason , they have no right to withhold your leave in such a manner. According to the Maternity Act , you have the right to avail your maternity leave when you are about 6 months pregnant i.e. 3 months before the expected date of delivery. So you should avail your right and not let your company take undue advantage of your innocence.

Go and talk to your manager and I am sure he will be able to understand you. Tell him that due to your health concerns you have to take your maternity leave right now. You can understand the situation of your company and thus want to help them out in this difficult time but they should also try to understand your position and you really hope that if they see this situation from your viewpoint, they will surely give you your leave.

I hope your manager will try to understand your position and thus will sanction your leave. But if he doesn't then you should still take your leave even if you lose your job in this process. Thus friend don't worry about your job at this time. Many more jobs will come and go but this time of your life is very important for you and make sure you do what is best for you and your baby.

I hope you undersatnd my point and will do as i say. Good luck and Thanks

    Hello Aspirant,

Your company has issued the notice pertaining to cancellation of leave in the interest of the company, but it does not mean that no employee can go on leave.suppose some employee is unable to work due to serious health disorder, the management can not deny to sanction the leave of the concerned employee.

Likewise your case is more important than the project work of the company.Get a medical certificate & apply for the maternity leave.you need not bother for its approval.Just get a receipt of submitting the leave letter & convince the concerned authority orally that you can not work due to pregnancy.I think you are well aware of the period for which you are entitle to get the maternity leave. It is for 12 weeks,6 weeks before the expected date of delivery & remaining after it.

    Thanks & good luck.

    Ashok..
