    Is it legal to fire me for being seen in a bar after taking a medical leave?

    I am an employee in garment management section of Gautam Textiles. I have been on a medical leave for 2 weeks. A friend of mine requested me to pick him up from a local bar. Some of my colleagues saw me visiting that bar and had complained against me to the boss. So he scolded me on phone and also on verge of firing me. I could not get it that without any prior reasoning is it legal to fire me?

    As you are in a private organisation so it all depends on the decision of the management of the company. As they are the owners of the company so they have all possible rights to keep or remove anyone according to there need or circumstances. See in your case as far as management is concerned they have to be really strict so that the discipline in the company can be maintained. As you have said that your colleagues has complained against you so the management have to respond seeing the situation, by taking such decision they want to show the employees that no tolerance is there for doing such acts, though you didn't did that intentionally but the management had taken the decision based on the information they have that was given to them by your colleagues.

    It would be better that you go and talk to them regarding this matter and make things clear with them. Don't try to find out legal aspects of this as this will create more problems for you. Your aim must be to save your job which can be done best by clearing the matter with the management. See as you were on medical leave which means that you are not in condition to work or is in need of complete bed rest so the company expects the same. So it would be better to be sorry and try to sort out the matter politely.

    As you was in medical/sick leave you should have at home for taking rest.If your friend requested to pick him up at bar, you would have told him that you was sick and taking rest at home. But going there and picking up your friend at bar seems to be not correct as you was in medical leave.In this situation normally everybody in the opinion that you simple applied sick leave for your personal works and moving around but not on the ground of health.So take it easy and not to think always this matter and attend your works normally. Maintain good relations with boss as well as your fellow staff to get the normal/peaceful situation in the work place.

    Dear Aspirant,

    You should have patience to deal the situation.Patiently you should explain the matter to your boss,he may realize it & excuse you.If at all,he imposes any fine to you,you just deny of being in a bar & show a medical certificate to your boss.

    Also you should meet your manager HR & give a representation in this regard,because for sake of justice,you need to approach the senior member of the management.If at all,if your case is not entertained,take it as a lesson for future & console yourself,because the problem is every where & you have to tolerate & manage the situation in order to rise in life.

    Dear this is absolutely illegal to fire you from the company but you should not be back in this situation because you have to fight against the injustice happened with you because of the misunderstanding of your colleagues and this type of cases happens so many times because of not taking anything positive by colleagues so they think something wrong about us and complain but be confident and do it :

    First of all you should not call the boss and directly go to the office of your boss and and request then you listen to you at once and when your boss listen you then you should mention all the cause that why you was there and you will have to tell that you was there to pick up your one of friends because he called you at that time to pick up him from that area so you was there and nothing else and you have nothing to do with the bar or anything because you do not take any interest in all these things then your boss may understand

    If your boss ask you about the proof then you should call your friend and do not leave the office that time because someone may think wrong while this time so you should call him to your office and when he comes then present him in front of the boss and do not say anything from your friend otherwise colleagues will think that you have made him for your safety and let your boss ask all questions from your friend and when your friend will tell everything clearly to your boss then they will definitely accept your argument and will allow you to come back to the office from next day and call all those employees who reported about you and scold them

    You must talk to all those colleagues who seen you at the local bar because if you will not talk to them then they will not feel that they have done a big mistake of their life which can make them shamed anytime because due to their misunderstanding, one person was about to leave a job which is mandatory for survival so you should talk to them and request that first understand the situation and get the proof then complain otherwise try to make yourself better before complaining others
