    Leave not approved even after showing medical records of miscarriage

    Recently, I had a miscarriage and it has drained me emotionally and physically. I needed a break but my boss is not too keen approving my leave. I have showed him the medical records and hospital bills. How should I put it again without straining the terms with the management? Please suggest me a solution.

    Every concern pvt or Govt must approve the doctor's advice otherwise the office boss/company will be liable to make compensation if the concerned employee goes for legal help.Here as per statement a lady did not get leave after showing doctoe's advice to take rest but the office did not approve her leave.Now lady can go to court for legal help,miss carriage means losing of chance to be successful parents.If the lady never get to be a mom only due to boss who did not give approval of her leave petition during the time of pregnancy is really an unprecedented incident.

    So it should be obeyed leave is not the birth right but sometime birth of a baby turned into miscarriage then such idiotic proverb will lead to pay sufficient compensation to the concerned employee as a result company is bound to loose it's popularity to it's employee as wellas to the related customers'.So,leave sanctioning is a serious matter it must not be ignored by any boss ahen doctor's advice is there.

    First of all I am really sorry to hear about your miscarriage and wish that you recover soon both emedically and emotionally. I think that would be a combined support of your family and your office. Sometimes situations are such that they are difficult to communicate verbally and as far as I what I can make out is that you have had a verbal communication with your boss. You should first resort to a written means of communication. The most effective one in that case can be an email. Be very formal in your tone and mention that it is a huge personal loss for you and hence you need time to get over the trauma. You should also mention that all this will cause you to become inefficient in your work at your office. You should also say that you wnat to be fair to your work and hence want to first settle down emotionally and then resume your work at the office.

    You should also seek help from your doctor. You can ask him/her to write a medical prescription for you stating that a certain specified period of rest is important for your health. You can then produce this prescription in front of your boss and request him to understand your condition. I think this prescription should be instrumental in help[ing you convince your boss about your medical condition.

    You can also tell your boss that incase of some important work you can work from home and complete the task. This would serve two purposes. This would create a good impression on your boss. At the same time it will also help you be a little busy at home. It can help you divert your attention from your gloomy thoughts at home and not even be too stressful at the same time.     As you have a proper medical proof of your miscarriage and your boss is denying the fact, I recommend you to please write a leave request letter with proper explanation of need and with medical proof to your senior management of HR manager. I recommend you to meet personally with senior management for demanding your leaves so that you can clearly explain your situation to them. I am sure you will be provided with proper leaves so that you become healthy and fit and can rejoin back to your organization.

    The only way for this is to go for HR.

    Go to HR and explain the situation clearly.

    If we have any queries, manager should resolve.

    If the problem itself is with the manager, then our ultimate destination point is HR.

    HR is the persons who will do justice in this case.

    Approach him and get your problem resolved.

    hello dearI am very upset that your boss is not accepting your leave application in such a critical conditions.This reason can be connected some typically conditions like official work is going overload or staff is less then mandatory.But health is greatest thing in all over things for a person.So you should try to convent your boss verbally with taking all bills and doctors appointment.Because boss is not always right so you should clear your all disturbance conditions those you are facing right now.I hope your will be conveying if he/she has minimum human beingness.best of luck

    It is a matter of great sorrow that you had to face the problem of miscarriage.As per the maternity benifit Act 1961 your boss must approve your leave for maternity leave for a period of 6 weeks after the date of your miscarriage.I think you have not approched him in proper & administrative way.

    In order to get your leave approved,submit your leave application along with the medical certificate advising you to be on rest for the said period.Get a receipt/acknowledgement from the office.If you don't get acknowledgement,send your leave application with the required medical certificate to your boss by registered post with due acknowledgement & be on leave provided you have worked for atleast 80 days in the calendar year.

    You need not worry for office work & have rest.Join duty after completion of leave & with fitness certificate of the concerned doctor.You will get full pay & if you feel difficulty in it,you may send a legal notice to your boss.But I don't this this stage will come.Before taking help from legal section,try to convince the boss with fact & figure.

    Your leave for miscarriage rejected by your manager because may be you consumed all the available leaves so far. May be there is urgency in project that require your presence.

    We have to think in their stand point of view also. So better to request sick leave. Also request to provide WAH for you. So that you will work at ease and take rest simultaneously.
