    HR is not ready to take me back even after promising me the same

    I am working in AGV Company past 4 years, due to my health problem I have to quit the company and take rest as suggested by the doctor. Before leaving the company the HR assured me that they will take me back after I am perfect with my health. Now I am perfectly alright with my health and my company is not ready to take my back for my designation. I am suffering without job.

    For answering this question first you have to answer whether you have got any written assurance. If they have given it then you have a good case. IF they did not give any written assurance then you chances of getting back is very less. If you have got a written assurance then you can very will compliant before the labour officer. But there is no law that when an employee takes leave due to health problem he should be re appointed after he is completely in good health. It depence upon the policy of the company. It is the discretion of the company whether to take you back or not. But the thing is that your company has to give your full and final settlement.

    Dear Aspirant,

    From your question,It is not clear whether you have produced the medical leave along with medical certificate before quitting the place or whether you have resigned from the job.In the case,it depends upon the management to give you re-employment.If you have applied medical leave with doctor's certificate with receipt of acknowledgement,you could have right to get your job legally.In this case you can send the pleader notice to the manager HR.

    In hte present situation,you have another option to search for another job or try to convince the manager HR of the present company,to consider positively & give you re-employment.

    As per your statement h/r is not ready to reappoint you though he promised to give you the same.now you did not mentioned whether there are any t&c behind h/r promise.

    Because they are high official they never bluff you.you have the right to create pressure against him gradually,ultimately he will create an opportunity to absorb you to keep his commitment.

    for this if you have made any aggrement for this particular period of time with the company then you have a clear chance of getting into he company again if there was no such wriiten assurence then the chances are very less and the cause you taken leave also have effting this so it depends on the company polacy and the job reqriment of the post you have done

    Hi.. It is very deplorable and sad that your company must do a thing like this.. It is really very irresponsible and inhuman on the part of your HR to do something like this..

    But unless your HR gave to you in written that you will be taken back after improvement in your health you cant do much about it.. If he has only given a verbal promise then you certainly cant do much about it..

    If he has given to you in written and signed it which i dont think will be the case then you can file a complaint against him..

    But you should not loose heart and try to search a new job.. Have self confidence and you certainly will have a very bright future..

    Hi friend,

    Before taking any action make sure that have you got any written assurance, saying that they would offer you a job after you get recovered from your health.

    If you have got that assurance letter then you can go to the consumer court and lodge a complaint.

    But if you haven't got any written assurance then it would be a problem to you.

    Make sure whether there is a vacancy in your company or not.

    If you have got vacancy in that then you can request him to give you the job because you haven't got any other job and you are in very much need of it.

    Ask him in the pleasant manner so that he would understand the situation that you are in, make him understand your position.

    If you haven't got any written assurance then you need to request him.

    There is no other option for you.

    They will not let you in unless you show them the agreement in which it is stated that you will be allowed to resume your job after a specific time period. If you do not have it or they havenít made it then it is very difficult to get back the job because it is the only thing that can be act as a proof for it.

    no one will allow you to join the same post after such a case if you are not having any legal document signed by HR if you have then use it by showing that to the higher authorities if you dont have that then thisis a big mistake done by yourself

    If there is any written agreement or assurance then you can take the legal action against the company and the responsible officers. Only an Oral assurance from HR wouldn't be helpful for you as if the HR denies about this promise then nothing can be done. So NO Legal protection is available untill and unless you proof. Apart from it you can contact the higher officials, tell them about the promise from HR and also convinance them about your ability and also provide them your past record in the company to get back your job again.

    Being 28 years candidate your not applicable fo IBPS Clerk Examination .. Because to participate in IBPS Clerk Examination than your age should be Minimum 20 years to 28 years ..

    So, At your age is 28 years .. So, your not eligible for IBPS Clerk Examination ..

    Please Note :- But , If your belong from Reserved Category candidate than your eligible for IBPS Clerk Examination .. Because Upper age relaxation will applicable for sc/st candidates and obc candidates ..

    But your eligible to apply for IBPS PO Examination and To appear in IBPS PO Examination than your age should be Minimum 20 years to Maximum 30 years ..

    You have Mention your Academic Qualification here .. To appear in IBPS Clerk as well as PO Examination than you should Complete graduation course from recognized university ..

    So, If your aspiring to apply for IBPS Clerk / PO Examination than you need to satisfy the educational Qualification too ..
