    How to get back my position that is taken from me in my absence?

    I have been serving a company for 10 long years. But recently I was on a leave for my back pain. After getting cured when I rejoined the company I was given a low rank job of minimal work and some other person was placed in my position. What are my rights to get back my original posts that I was assigned before the leave?

    Yes,it is usually happens in the corporate life,because works at the important places have to be carried out daily,some one has to be given the responsibility to look after those important works.You can claim for the post,if you have been demoted to the lower post,otherwise when you have been posted to a post which is less important in terms of works,but,if you will get equal pay to the previous post,then you have no right to claim for the previous post.

    Slowly,you should approach the management to get you posted at the previous post,but you can not claim as a matter of right since you have not been demoted & getting equal pay & perks as previous.

    If you have been demoted,you must claim to the management in writing to get you promoted to the previous post,as you were on leave in need & it is the right of the employee to go on leave in such case.

    So see your position & proceed further.

All you can do is talk to your boss and tell him that you were on a long leave for a genuine reason. Also, assure him that you will take up all the previous responsibilities with great efficiency and confidence. In fact, request him to give some important deals/projects so that you could get an opportunity to prove yourself and get back your position. Do not worry, accept it as a challenge and please do not run away from this problem or think about leaving the firm. Be a fighter, fight back and come out as a winner..!

Only on medical ground you went on leave. what were the terms and conditions mentioned in your appointment order which was served at the time of joining. Is there any specific reason in this regard ? If not you can approach your manager concerned and find out the reason whey they have made this alternative arrangement. If your job is such an important and your absence may lead the problems to the company due to pending of works, management may take alternative person for complete the tast.In this case you request the top management and convince them by giving assurance to complete all the pending works in due course in written if they agreed,you can get back your position.     I think you should work hard enough so that seniors them-self comes to you and ask you to join your post again.
    Don't try to do anything negative for the person who took your position. This may lead in lowering your good will in organization.
    Try to be friendly with everyone , help everyone so that no one questions you about your performance.
    Your hard work and dedication may help you to attain your position back .

    If you think that your position is snacthed by any other person then you should speak to the boss regarding the same because it is totally not fair that any other person is getting the place of you and you are getting the other lower work as compared to your previous work.
    If they have not intimated you that your poition is given to anybody else then you have a right to information to know the reason behind it.
    If they are not providing you the proper reason for that then you should file an RTI against the employer for the demotion without any reason.
    You should know that RTI works in terms of the private owned bodies so if you take the help of RTI then you will get the position back.
    You only need to go to the www.rtionline.gov.in and file an rti against the employer along with your employee code and name of the organisation, along with the employers code as well,
    You also provide the pvt limited company name to make your points clear.
    After filing the RTI within 1 month you will get the reason for the same.
    If the reason is not true then they will be charged 25000 for that and again they need to provide the reason.
    If you are not satisfied with the reason then you should make first appeal after that, if you are not satisfied by the same as well then you can file the second appeal as well.
    Then you will get the proper reply by that.

    if you want to regain the position which you have left in this company, then you need to do some more hard work in such a manner that you can impress your boss and regain your position in the company.
    And as you have said that you have gone for the treatment, during that period of time there might be a possibility that someone needs to be appointed at your post and that is the reason why your boss has given your post to someone else

    I did not personally heard this i think this is not fair with you.. What company has done is big blunder on part of decision making.. There also open window for former employee in any company.. You have very long service of about 10 years you can harding find employees who serve very long for the company in the competitive world today people follow up rotation policy to get hike in their salary but your so sincere in serving the company.. My suggestion is that you go to talks with management or talk to hr manager about the position they have been offered you after rejoining.. Company should know who to respect employees who are seniors.. Its really difficult to work under rank with your previous position that you held with in the same company.. Don't accept any solution other than you get your original position.. If you adjust now with the current position then you should have to compromise on many others issues.. Don't compromise on issues which under- determine your pride and position all the best

    it is quit obvious that if you are in a leave may be due to back pain or some other injuries,the other person gets opportunity, and so you have to manage with low grade work.
    don't worry there is a famous quotes "everything happens for our own good ", just chill ,relax and start doing your work more effectively. try to convince your boss by your sincerity and intelligence. yes it will be not so easy for those who come back to work after injuries but don't loose hope and just focus on your work and concentrate on it.
    definitely in some day you are going to come up with the flying colour. just run before excellence and leave the rest.

    Just tell your boss to some genuine reason hope he or she will surely understand and provide you another option.

    You have full right to get your position back.
    After serving the company for such a long time, and you get such results , is unfair.
    The company manager should provide you your position back.
    As per the rules an employee is given back his own position after leave.
    But, your company has done wrong.

    You must talk to higher manager or HR .
    Give them every detail of your job since 10 yrs and now you have got placed in low rank job after leave.
    They will surely get your right back to you.

    You must fight for your position but cleverly.
    Do not get angry or shout on anybody or your boss due to such problem.
    Handle with cleverness.
    You will surely get your position back.

    Hello friend as you said that your place has been taken in your absence now what you have to do is that prove him that you are not less than anybody. make him realize that what mistake he has been done by dropping you from your place where you deserve. Make him impress by your confidence. If then he will not give your deserving place back then file an rti among him.
