    How can we claim ESI money if not used as medical claim?

    In my office there are employees whose salary are below Rs.15000 and a amount of specific percent is deducted as ESI’s.Are there any regulations against which a employee can claim his deposited amount if not used in medical receipts?

    Dear Aspirant,

    E.S.I. means Employees'state Insurance.The regulations regarding establishment of employees ' state insurance corporation was passed by the central govt.in 1948

    As per the corporation Act,the employees have to contribute money in between from 1st April to 30th September & 1st October to 31st March of a year in order to get benefit in between from 1st January to 30th June & 1st July to 31st December respectively of the year.

    So the question of refund of your deposited contribution does not arise.

    Dear Friend...
    First you need to understand what ESI is. ESI is a social security measure. There are 5 benefits of the same.
    1. Medical benefits –Where you get all the treatment and medicines free of cost with some conditions applied.
    2. Sickness Benefits – Where you get leaves if you are not well and also get paid for the same through ESI.
    3. Dependent Benefits - Where if your dependent needs medical attention can avail for the same through your ESI card.
    4. Disablement Benefits – Where if you are disabled in an accident, you get pension depending on the disability.
    5. Maternity Benefits – If a women is expecting, then she will get all the maternity attention required.
    Apart from the above mentioned benefits, there is also funeral benefit or Rs.10,000/- in the most unfortunate situation.
    All these benefits can be availed if the person is eligible for ESI i.e., if his/her salary is 15,000/- or less and if he/she is enrolled under the ESI scheme and only if he/she approaches the ESI when there is a need for medical attention.
    The contribution period is from April to Sept – the benefits of which can be experienced in the following months from January to June and the contribution period from October to March – the benefits of which can be experienced in following months from July to December.
    If the ESI benefit is not availed in the benefit period mentioned above, the money gets lapsed. You cannot avail the benefit if you have not availed medical treatment from ESI i.e., if you have got treatment from private or govt. Hospitals. You have to only approach the ESI dispensary for availing benefit. So you cannot produce receipts to avail ESI benefits.
    So to answer your question there is no way you can claim ESI money if not used as medical claim.

    Hi friend,

    For an employee getting less salary to hand it is very tough to manage things. Whatever may be the salary there must be some fixed deductions for all the employees. I will understand your problem.

    ESI allows amount to be used in specified period after that it won't be refunded. For example after the period you cannot claim that amount..
