    Got terminated during my maternity leaves without notice period

    My aunt was working on contract basis in government office. She was working there from 3 years. It was at the time of her maternity leaves. When she went to her office after her maternity leaves, she was informed that they donít need her any more. They have found an alternate resource for the same position. When she confronted them about this, they did not respond it properly. How can they terminate an employee without notice period? Are contract people are terminated without any notice? Please tell me what is the next step taken for this.

    Temporary workers can enjoy the benefits like the permanent employee.


    1. If the contract period is over then you cannot ask them back .

    2. They should be treated with no discrimination like the permanent employee.

    3. Notice period should be given if still her contract period is not expired.

    4.You can fight for it legally.

    5. Contract employee has all rights like the permanent employee as per law.

    6. No discrimination should be shownn towards contract and permanent employee.

    This is utter nonsense. They cant do this. All you can do is contact a higher authority of that office and try and solve this matter. If not then go for a consumer court hearing .

    They will definitely help you. You cant actually terminate a employee without notice plus a women who is on maternity leave. Many organisation are also available for women contact them, may be they will find a solution. All you can do is try but its better not to work with such a useless company . I dont think they have any values or morals.

    I would ask her to try for some other company.

    The main thing to look here is the Contract.Generally in the contract based job the company has the control over when it can terminate the employee's job.
    You should first look at the contract if there is any term and condition regarding the termination of job.If there is no such term that the company can terminate job at any time you can file a complaint against them and can ask for compensation.But if there is any term clearly mentioned then dont waste your time and money on this matter.

    If the Contract period is over then you can directly ask them or question them for doing like this .

    They Should treat as the Permanent employee with no Discrimination

    and a notice period is must be given if the contract period is not expired .

    you can even raise a complaint legally . and its shame of the company that they dont have such values or Morals

    1)you should follow the rules and regulations in the company

    2)if you not follow the rules they will take action on you

    3)need to serve notice period before taking maternity leaves

    4)otherwise they will take strict action on you

    5)that' why there are terminated you

    6)if you are not worked no problem but maintain the discipline and follow the rules of the company
