    Employee replacement doing a brilliant job what should I do?

    The employee replacement we hired to take place of an employee on maternity leave is doing an exceptional job. Now that the employee is ready to come back , i donít want to lose the replacement. What should I do?

    Dear Aspirant,

    You can not over look the rule.Otherwise you may face legal procedure which may be very much paining apart from financial loss.

    Since your previous employee was on the maternity leave,she has right to join again after completion of the maternity leave with a medical fitness certificate.You can not deny her joining,otherwise she may take legal help.If you don't want to loose the new employee who was appointed in place of the previous employee who was on leave,you can ask her to continue the job.In this case you will have one more employee.Since you appointed immediately another employee & she has satisfied you with her work performance,It is difficult to oust her.I don't know with what terms & conditions,the new employee has been appointed.If she was not appointed for few months,she too can claim right to continue the job.

    So,It is better to lat both of them work in your company/office.
