    Employee appointed to our company need to serve his notice period to the previous company to get his experience certificate?

    We have appointed the employee recently. His previous company has not relieved him and asking him to serve 15 days notice period to get his experience letter. We had taken this employee on the promise that he will provide us the experience after 1 month of joining. Now he is telling that he has to serve there for 15 days to get it. I am worried now. I had appointed him. What should i do now? Should I terminate him on the ground that he has not completed his notice period in the previous company and has joined without experience letter? Or should I wait for him? What is the guarantee he will come back? Please suggest.

    you should ask the employee to first settle his dues in the previous company and than only he can continue working here
    If he does not serve notice period there that comapny can ask him to apy 15 days salary and than will relive him and giv ehim the experience letter

    this is being done in most of the companies
    so just ask him to do so and he will get the letter after paying the 15 days of his salary

    Don't worry for this issue .

    Employee has agreed to provide the experience certificate in 15 days . Think from the side of employee its not his mistake . As a employer even you will ask for the same to issue notice period . The same happened in this case . So please wait till that period patiently . If he doesnt provide the exp certificate as said within the said period , you can take further actions upon discussion with your senior officials

    Dear Aspirant,

    It is not a difficult situation to worry.

    You have appointed the candidates on the promise that the appointed employee will submit their experience certificate.

    But they are unable to do that.

    It is not good to terminate on this ground.

    There are two options for you.

    One is to see their performance.

    If they are up to mark of your satisfaction in work,then I don't think there is necessity of the experience certificate.

    In spite of that if it is badly needed,then you can give them chance to get their experience certificate by giving them leave on loss of pay as required to get the same & not by terminating their services.

    hi friend,

    Its the company rule to serve the notice period by any of the employee who is working in the corporate world.

    If you think that the employee you have appointed is worthful to you and has good skills then you can wait for him, as he said that he would produce the experience letter within 15 days.

    If you think he is needed to the company then let him serve the notice period for 15 days and if he doesn't turn up then you can take the action on him, as he has joined the company by voilating the rules.

    As he himself said that he himself will submit the experience letter so you can trust him as he has got no other option to serve the other company for 15 days or else he would not get the job in any other company as he has already left the previous job.

    You can trust him as he has got no other option but to serve the notice period.

    Accordingly when you serve to a company do good relationship with all specially with your senior and boss.it is quite natural pvt company require to live company without notice to join better company or to opt better post by way of showing experience letter.

    Present company had the agreement their appointment letter will valid till they submit experience letter.now the employee asked to serve notice for 15 days' to get experience letter.present company is thinking should i terminate him as is unable to produce experience letter,again thinking after termination shall i get employee.

    Come on if you had the good relation with senior and boss definately they can do something for you in issuing experience letter thinking as in pvt.company it is usual usage and the employee had good record with us regarding his dedicated works.

    So we can issue an experience letter instead 15 days' notice.

    &_& Its must for an employee to submit the leaving letter to the new organization &_&


    &_& Sometimes by mistake it may delay because of the organization not by the employee &_&


    &_& Give a 15 days leave and ask to submit at the end of it &_&


    &_& If he/she did't do it then you can terminate &_&


    &_& In this period,he/she has to get the leaving letter to the company &_&

    Hello Friend,
    yeah this is a issue with almost all companies to issue notice period to an employee,they delay because its a long process and that's why may be that employee could not produce the experience letter in your company.
    but if he need that job he wont cheat ,and he will join again your company after serving 15 days in other company....and if he do cheat then you can take action against him as per the terms and condition on the bond which he had sighned on the day of joining your company.but you know the notice period is not that easy...i am highlighting the process of notice period why it gets delayed and why you should give him a chance.

    Notice period is important,and you need to follow that procedure.
    due to following reasons they need you to serve the notice period
    1-they need to get a new resource in place of you to handle your work
    2- they need to give him KT(Knowledge Transfer).
    3-you need to take clearance from all department
    4-you need to return all assets (like company laptops,headphone...etc)
    all these thing need few days to complete mostly the new resource Assignment and KT take a lots of time thats why they keep a long notice period.
