    Does a shopkeeper has to take responsibility if the manufacturer does not fixes the problem of a product within the warranty period?

    I am a hardware dealer. I had sold a Micromax handset to a customer. After some day customer come to us and complains about the product. So I said him to go to the customer care who can fix the productís issue. But he once again returned and said that customer care are saying the product was damaged from first so they will not handle this issue. And now customer has threatened me that he will file a case in consumer court. Do I need to take the responsibility.

    The manufacturer is responsible for product replacement during warranty period if the there has been any sort of manufacturing defect. Apart from manufacturing defect, the manufacturer is not responsible for any other damage. You are just the dealer. When you have sold the particular set, you had opened the seal in front of the customer. This means, you have not opened it before selling to anyone. So it clearly mean that you had no idea if there was any problem or not. So the liability doesnot rest on you. It is the liability of the manufacturer. I think you should immediately talk to the manufacturing company to make them understand their own responsibility so they cannot shift the liability on your shoulders.

    If the damage was done on your behalf then you have to take the responsibility of the product otherwise
    you should contact the Micromax company and ask them to kindly replace or repair the product as it was
    damaged from the first hand. If they refuses to do so then you have to use your rationale to see whose
    fault is it your's ? or the Company's? If both of you stick to your judgement then the blame game will continue
    and I am afraid you have to go to the Consumer court. So, better sort out the issue quickly.

    Dear Aspirant,

    Need not worry much for the case being faced.Every thing is mentioned in the manual book of the product regarding warranty.So you must refer the manual of the product.Also you may contact the dealer/distributor/manufacturer to discuss the issue.In fact,the guarantee/warranty is covered by the manufacturer through the retailer.If there is a provision of guarantee,the retailer accepts it & send it to the company for replacement.

    There is a warranty/guarantee card issued by the manufacturer to the retailer which is in turn issued to the customer with date of sale,sign & stamp.If there is no such provision in the sold item,you need not worry for the consumer case.You should mention the fact in your statement of facts to be submitted to the consumer court.

    Your advocate will do needful to you,in case you get a notice from the court.

    So need not worry & be happy.

    hello frnd. your customer will file the case in court. because customer care of micromax is not taking care of his problem. so in my suggestion you should take care of his problem. else he will file the case and ur time will be wasted

    Yes you will have to take the responsibility and surely this is your fault that you sold him a dead stock!
    When a customer purchases ant product from you it directly implies that he has faith in you and your products and you should try keep it. You should have checked the set before displaying for the sell.
    Now being a certified customer of micromax its your due responsibility to either get the handset repair or to replace it.
