    Company is forcing me pay amount even though I had left the organization after the said period as mentioned in the offer letter

    I was working in Emphasis on back end process. I was there for 9 months on probation over there. Because of my health issue I had to leave this organization without serving the notice period. After 6 months I went back to the company and asked them the reliving letter. They are telling me to pay Rs.50000 as I had left the organization without serving notice period. As per the policy if the employee leaves the organization within 6 months without serving notice period, they have to pay Rs.50000. but I have completed 9 months and had told the reason of my leaving. Please help me in this. What should I do in this case?

    If your company has a policy that if an employee leaves the company before giving notice period who has worked for less than 6 month then you are safe. You have worked for more than 6 months and hence you are not liable for paying 50,000. Its the companies Technic for extracting money from you. You have to resist it.

    It is better you give a written explanation about the same to the HR so that you are safe. If your company takes any action there is no need of panic because you have not done any wrong. Most probably they are not going to take legal action. If they take any legal action you can very well defend it with the help of good advocates. Don't bend your legs for not fault of yours.

    If they are not giving relieving letter then you can give a written compliant to the labour officer in your area and I am sure that he will definitely help you in this regard.

    Dear..

    One thing that i want to to tell you is that if you have completed your 9 months then there is no need to be panic, You have done your part of job well and now you can ask them for a relieving letter. You should write a letter to the HR of the company saying that you have not violated any of the policy so please grant me my relieving letter.

    I advice you to check once again the rule book as some time without serving a notice period in ant stage of your job leads to a penalty so check and go according to whatever written in your offer letter.

    Hi.. First of all you check your company policy properly and make sure that when you complete 6 months you dont have to pay any compensation for not serving the notice period....

    If you are right then you try to get a proof that you have completed your 9 months in the company like your pay slips or any other proof..

    Then with that you go to the HR dept and complain to them.. They will try to help you i think..

    But if they dont take any action you file a police complaint against your company and sue them legally..
