    Can a previous employee of the company asks for Form No.16 to the employer?

    I am an HR professional. An employee of the company left the job and now he is asking for Form no. 16 for Tax deduction? Should I give him form or not as he is our previous employee and can he get this form from from anywhere if I refuse to give him the same?

    Hi Sir,

    It is the company responsibility to send Form 16 of previous year to all the employees including the employees who left the company last year.

    you should give him the Form 16 form for Income tax submission as he was a previous employee of your company.you can provide Form 16 the one which was the last before he left the company means you can provide the recent Form 16 to him.More over that is the duty of HR to keep track of previous employees and send their Form 16,it won't create any problem to you as well as company.

    He will not get the form from anywhere,company needs to provide it,so kindly don't refuse the same.Let him receive his Form 16 and get his extra tax deduction back.

    Dear, asker let me tell you that form 16 contained the detail of bout income tax returns.so if someone is presently serving in the company he have to pay tax as fixed by (CBDT). In the case of a employee who have left the job he is not to be fully worried about that form because it is the total responsibility of that company or employer to provide the form 16 to his employee who had left the job one year back to fill the income tax return of previous year in the case of employee who have left the job last year.     Hi,

    I would like to let you know that its only the company's responsibility to send the FORM 16 to the employees who left the company before completing the financial year. The employee can not take the Form 16 from anywhere for those period which he/she spends in your company. Only company can give him the Form 16 to file the ITR. Form 16 contains all the details like Gross salary which he got in that period, the deduction, investments etc. Once the person will file the ITR he/she will get the extra deducted amount back in their account. If in case you have not send it to them by your own, and they are requested to you to send the same, then of course without any hesitation or thought you have to send the same to them. It wont create any harm to you or company, because its your job.
