    Can my son apply for non creamy layer certificate based on my annual income?

    I am working as a primary level teacher in Saraswati Sishu Vidya Mandir. My annual income is around 12,00,000 lacs from which salary received from the school is 1,44,000. And rest of them is from personal tuition fee. Can my son apply for non creamy layer certificate?

    Dear Aspirant,

    As per rules,if the total family income yer year is up to Rs.4.5 lac,the family comes under Non creamy layer for OBC.Here it is to be noted that the amount from salary & agriculture is not included in the income for the purpose of OBC certficate in Non creamy layer.

    The income up to Rs.4.5 lac is countable for business man.I mean to say that if the income from business per year is more than Rs.4.5 lac,the family does not come under non creamy year.The income is considered for the three consecutive years.I mean the income from the business should not be ,more than 4.5 lac for the three consecutive years to get the non creamy layer certificate.

    In such case,your son is entitle to get the non creamy layer certificate of OBC.You must try for it.

    it depends on this whether you have shown 12,00,000 lacs per annum income while filling your income tax or not.
    If you have not shown this much income in filing your return of the income tax, then this whole money would be considered as a black money, and you asking to give your son non creamy layer quota even if you are earning 1 lakh per month? Please itís a request donít do this because you are actually killing the seat of someone who deserves it

    The NCL certificate is based on the family income. As your total income is around 12 lakh rupees your son is not eligible for the certificate as he

    comes under the creamy layer quota. But if you just want an OBC certificate than you can apply for it if your caste is mentioned in the list of OBC of

    state or central government under the creamy layer OBC.

    As per government rules the non creamylayer candidates are those ones who comes under Other Backward Castes and their family/Father's income is less then the limit which government fix time to time.

    So if you belong to OBC caste and you do not have income more than the limit that government has fixed to become non creamilayer.

    But the government limit is 6 lacs per annum and your total income is 12 lacs.

    So legally you can't make OBC non creamy layer certificate.

    Hello
    well does your tution a part time job at home or you are enrolled in some institution where you get this pay?

    if yes then,
    You must be getting a pay receipt which further goes into tax etc considerations etc
    and there intotal your income accounts up to more than 5lacks annually and hence you can not prove your child for the non creamy certificate.

    and if not
    Then your income under the documents would be less than %lacks per year and hence you can apply for the non creamy layer certificate for your son.

    Normally an OBC candidate having parent's salary income above 4.50 lakh is not eligible to get the certificate and please don't tries to get the same as it is a totally wrong concept. And the person who are employed but not filing the income tax return should submit the salary certificate xeroxed. Income of all earning family members should also be mentioned in application and if they are not employed then it should also be clearly mentioned in the affidavit.

    So basing on your salary certificate only you may apply for non creamy layer certificate but don't try to add your personal income getting through tutions as total income source. Regards.

    Yes it is possible
    I think it depends on this whether you have shown 100000 laces per annul income while filling your income tax or not.
    If you have not shown this much income in filing your return of the income tax.
    Then this whole money would be considered as a black money.

    hello,
    there are certain conditions that you should follow if you want to apply for an obc non creamy layer,
    you should have family annual income less than the 4 lacs and you should specify it.
    you said only 1.2 lakhs is the salary then you can apply for it as they see your annual income from your side and not from your tution side.
