    Can a minor be recruited into a company if he solely accept the circumstances in which he will working?

    I am a HR in a PSU. A minor has come to me and is asking for job. He has mentioned all the problems for which he want to do any job in our PSU. I offered him the education facility that is being provided by our company and asked if any elder in his family is willing to do the job? He only has a mother so he refused his mother to work in a PSU. I am moved by his spirit and determination so I want to recruit him into a post. But I am worried about the actions that can be taken against me for recruiting a minor. Am I right in giving him a job or not?

    Hello Friend,

    Well, I can understand your postition but you have to follow your company's policy on recruitment. In a Public Sector Unit there is no room for minor. He should 18 years of age in order to get the job. I know you are considering this option based on humanitarian grounds but you have to think about the consequences in the near future. You should talk to the higher authorities and ask their suggestions in this issue. They will surely give you some valubale inputs in this matter. You should talk to this brave minor and tell him to concentrate on his study right now and after the completion of his 18 years of age he will be given an employment opportunity to th PSU. You have to convince him so that he can understand you problem.

    Whatever you do you must follow the company policy of recruitment and you should not violate any norms at all.

    No, legally you cannot engage a minor in any work. Our Indian law forbids any one to get into a job under 18 years of age. I can understand that emotionally as well as considering his conditions, you are thinking of giving him the opportunity to get the job, but if you do so, that will be considered as illegal and against the law for which you might in trouble now or in future. Working in a PSU by a minor is not a matter of joke. Making such recruitment shall not only put you in trouble, but also your company. If company's reputation is at stake, then they will not compromise with you at any cost. SO ask that boy to wait till he becomes 18. Meanwhile if you can arrange some money, then please give it to his family for their livelihood.

    Hello Aspirant,

    It is right to consider the case on humanity basis,but safeguarding own skin.You seem very kind to consider his problem & situation.But being an employee,you are supposed to follow the rules & regulations of the govt.The govt.has made provision to be adult of 18 years for human being & minor is not allowed to be recruited either in daily basis or in regular basis.If it is done,the recruiting officer will be liable for punishment as per the provision of the law.

    So ask him to wait till his age reaches 18 years & then come to you.He can spend time now for studying.
