    Can I deny giving any monetary benefits on taking any leaves in year?

    Sometimes it happens that my old employees who are working from more than 5 years donít takes any leave for whole year and asks for monetary benefit at the end of the year which is a loss to me. Can I reject to do that or not?

    hello,
    yes , you can reject this. as you are the higher authority so you can reject or accept the deal. and for holidays, it is provided to employees and they take it or not that is upto them . so if they have not they have not taken the leaves assigned to them , then this is not your problem.
    -->management duty is upto giving the leaves
    -->incentives will be given or not that is your decision, so you can say no

    Dear Aspirant,

    It is good for you that the employee does not ask you for any kind of leave for whole year.But,it does not mean that she is not eligible to take any kind of leave.Now the concerned employee needs her maternity leave,so you must sanction it & you must bless her for her & would be new child for well being.The maternity leave is controlled by Maternity Benifit Act 1961 passed by the central govt.It is not your will either to sanction or to reject it,instead you have to sanction it as per the rules in force.

    As per the rules,she is fully entitle to get maternity leave for 12 weeks continuously with the full pay,i.e 6 weeks before the expected date of delivery & remaining 6 weeks after the actual date of delivery.She is required to apply for such leave with a medical certificate.

    If you deny her leave ,you may have to face the legal procedure.You must be very kind to her,because she never asked you for any kind of leave during 5 years.

    Hi..............,

    You must work as a company rules and regulation.
    Company must provide a leave pay as a motivation to employees.
    If you want that employees need more work and less leave than must apply this.

    Hi friend

    1) Different companies have different rules in regards to this and so you can form the rules according to your own discretion.
    2) So if you want you can make amendment to the already existing rules and thus then your employees will not be able to exchainge their leaves with money.
    3) But I think you should not change this rule as this acts as an incentive to the employees to stay for a longer time in the company.

    4) So if you change this rule you may lose some of your employees.
    5) The decision is yours. Do waht is the best for the company.

    Hey!
    The question that you have mentioned requires you to look into the rule book of your company. If it is mentioned there that the employees will be given the benefit of getting paid for not taking any leaves then you cannot deny this to them. You will have to encash the number of leaves that the employee has not taken. There should no ambiguity in such a situation because whatever is mentioned in the rules of the company that has to be followed.

    You should also keep in mind that you cannot manipulate this at the moment because this clause would also be present in the joining letter that the employees received. It varies from organization to organization whether they want to encash the leaves that the employees have not taken or not encash the leaves and leave it to the discretion of the emplyee whether he wants to avail his leaves or not.

    In my opinion a better system would be to encash the leaves that the employees do not take. This will maintain a level of seriousness in the organization. The employees will take a leave only when the need arises otherwise they will not for the greed of being paid later on for the leaves that they did not take. On the other hand if leaves are not cashable then the employees end to take leaves for not reason.

    As a good administrator/employer you must encourage this usage of old employees,it is the profit of the company if the old employees go under leave then the works of the old employees will remain as pending then who will do that work.A fresher can not perform all works of old employees they have the expertise,skill etc ,now it will create bigger problem on behalf of the company for new recruitment toward the place of senior employee.

    It is far better to give extra monetary benefit to the old employees,your company is private so you can maintain this process,presently Govt.PSU concern allows to sell more leave because these are the good beneficial process.
