    Can a female employee take maternity leaves during probationary period?

    My wife has joined her current job 3 months back where she is on her probationary period for 6 months. She is pregnant but company havenít cleared up the norms. Can my wife take maternity leaves during PB period or she will be asked to resign?

    Dear..

    You did not stated in the question that from how much time is she pregnant??? See if she is pregnant of just 3-4 months then she can go to the office easily and work there. Even in some cases the ladies are working till the last month of their pregnancy so its not a big deal if she is 3-4 months pregnant. Some women have more problems and they have to get leaves early where as other do not have such problem so they work till the last month. It varies from person to person so its better you ask your wife that is she comfortable or not and if she is not then its better to talk to the seniors where is if she is comfortable then its better to work till the time she can work.

    Probation period does not have any role in pregnancy and you can take leave in such cases.

    Yes she can.Evey company has policy of providing leave on maternity grounds.Duration varies from company to company.Irrespective of the fact that she is in PB period she will be given neccesary leaves and com[pensation and company cannot sack her on this basis.

    Hi aspirant

    I am sorry to say that your wife is not eligible to avail her maternity leave because it has been only 3 months since she has joined this company and according to the Maternity Benefits Act, a female employee can only avail her maternity leave when she has completed atleast 180 days i.e. about 6 months in her company. So by virtue of this your wife is definitely not eligible to avail her maternity leave right now.

    So if she has to take leave of such a long duration at this time, then maybe she has to resign from her job. Or she can request her manager to grant her leave during this stage and keep someone temporarily at her place. She would surely make up for everything when she comes back. If the manager agree then its ok but you should see to it that your wife takes proper care of her health at this siage and also takes proper rest. She should not take any stress even if she has to leave her job for this.

    Don't worry such jobs will come and go. Make the most of these happy moments. Hoping for her safe delivery. Congratulations and good luck
