    Can the employer hire a retired employee into the another post than the post from which he retired?

    I am the proprietor of a Pvt.ltd Company. There was an employee of mine who worked for 20 years and then got retired. Recently he applied for joining again to my company. What can be the terms and conditions for doing the same? Do I need to recruit him back to the same post or I am free to give him another post fitting his age and agility?

    Hello Aspirant,

    Giving employment is a agreement between the candidate & employer,because the employee likes to work in any organisation till his or her need & satisfaction.If the need of the employees gets fulfilled with the terms & conditions in another organisation,the employees would like to resign from the present job & would like to join the next job.

    So you can very well recruit either at the previous post or at any post as you decide suitable for him.If you recruit at the same post,you may get objection from his successor as his/her promotion would be affected.

    In general the retired person is recruited on the basis of contract at a fixed amount which is paid to him monthly.He is not entitle for any leave.If he/she is absent from the duty,pay is accordingly deducted.

    So do as you want.

    Hi,
    According to my-point of view, just take a formal interview process of that employee and because 20 years is long time period and you have to judge that employee that its knowledge increase or decrease after 20 years. Because if you just give him joining and don't take any interview, then in this case may be your company have some loss in future.
    Because in any private company, profit comes from good/hard working employee's. So 1st judge that person and then take your own decision. Its not big deal that you give him same post or another new post fitting his age.

    Hello Friend,

    Well, it's up to you to decide whether to recruit the person to his previous post or to give him a new post. Generally, as a propritor you have the liberty to decide the position of the individual. But if you give him his previous post then it would be a lot easier for him to adjust to the working condition of your organization. On the other hand a new postion will require sometime to adjust to the situation. You should talk to the aenior officials of your company and decide which position will be best suited to the person. You can also talk to the person and ask him if he has any preference of his previous post of not.

    As per norms a retired employee can be re-appointed in the same post if you think you that no other person can do the same job as the retired one did . before it you have to conduct a staff meeting and have to take written acceptance from your present employees for the reappointment of retired person, as if any of your employs make object you in future . and last not least you can appoint him as a temporary employ but not as a permanent employ
