    Can an employee take a legal action or complain about the manager for forcing him to go on leave?

    I am working as a technical assistance in one of the BPO Company. I have been working in this company from past 3 years. Recently we have got this new manager to our team. He is forcing me to take a leave on the ground of illness. I donít understand what his motive behind that is. I take care of crucial work and need to handle the same to my manager when I take leave. I donít want to do that for now. Can I take a legal action or complain about him to the management for forcing him to take a leave?

    In Many Companies the Leave Policy states that Employee should utilise all his leaves within the financial year.
    No Leaves will be carried forward to the next Financial Year.

    Also in some cases, Management stresses that each employee should take leaves, just to relax and also get a break from his daily office routine.

    In your case, you need to talk to your Manager and ask him, is there some rule that forces employees to take leaves.
    If Yes than it should be told to all employees.

    If No, than you would only take leave when you actually require it.
    Also rebember, from time to time you should take leaves and get a break.

    The above answer is very good. I would like to add something to it though.

    Talk with your manager and ask him for the reason why he is asking you to take the leaves.

    Plus if he is asking you to take the leaves then take it and have some fun.

    If he doesnt provide you with the answers you can complaint about it to your management as you have every right to ask why the new manager is asking you to take the leaves forcibly.

    Plus as you are 3 years in this job you should be familiar with most of the rules right? So i dont think their is any rule that forces a company to tell him employees to take the leaves.

    Dear Friend

    Taking leave is not bad as it will relax yourself from the work of the office...

    Company management wants his employees to get the leaves in the same financial year as the leaves get cancelled in the next year..

    When you work in a private company you have to face a lot of stress so there is a requirement of some refreshment at regular intervals so you should take leave whenever you feel tired..

    The manager also have felt this about you..

    So just take the leave and get refresh and after that return with more fresh mind..

    There is no need to take action against him..

    Dear aspirant. . . . .you can not launch legal action on him. .but you can take this matter to your higher official. . .it seems you and your manager has personal crash if so speak to him frankly. .or else seek help to your higher official. . . .as such you can launch compliant on him legally. . . .hope it helps you

    There is three main reasons due to which manager may be forcing for you to take the leave
    1. In many companies, there is compulsory leaves which needs to be taken.
    2. Some times the manager in order to make you relax for some time, send them you for the leave so that after leaves your's working efficency increases.
    3. Sometimes manager wants to evaluate your work performance, so when you go for a leave they will check out your work.

    • It's will be better if you talk directly with the manager about this matter, so that you can come to know the exact reason.
    • If the manager doesn't provide any reason, then you need to complain to the management of the company against the manager for forcing you to leave the company

    Hello Friend,
    No body can force you to take leave without your interest,rather people force not to take leave as per business requirement so dont go on your manager words .ask him the proper reason for leaves else once you take leaves on his words if something goes wrong he will escape easily you wont be able to.
    apart from this ask him to put you mail if it is any thing related to project keeping all higher managements in cc such that you will have proof for your innocence.
    if nothing happens from manager side talk to his higher manager for the same issue.
