    Can an employee be eligible for gratuity if he has resigned before 5 years and gets complete after his resignation?

    One of employee has worked for 4 years 8 months and then he resigned and served 2 months’ notice period which comes to 5 years. Is he eligible for gratuity? He had resigned the job exactly completing 5 years. Please suggest.

    Dear
    according to the payment of graduity act 1975. All the employee who have completed his service and have retire from his post then he is eligible for the payment of graduity. For example in the case of service of polce the term of service is 35 years if he/she is not completed his service and have left the service after doing 5 years then they are not eligible to get the graduity. This is also applicable in the private sector jobs. No the above mentioned employee is not eligible to get the graduity.
