Can an employee consider the termination mail that has come from seniors Personal email id?

One of the employees was found guilty in sending confidential mail to one of his friend outside company. Senior manager found out this and decided to terminate the employee. He has sent this mail from his personal email id. As an HR can I consider this as official mail or should I tell the manager to send it from his official id? Please tell me.

It depence upon the terms and conditions of the company. If your company has a policy that official communication has to be send form the official E-mail ID then the communication regarding the termination of the employee has to be send from the official Email ID. As an HR you have to refer the rules and regulation of your company. With out referring the rules and regulation don't ask any thing to the senior manager and make him feel that you don't know the rules and regulation.

Most of the company has a rule that official communication has to be send through official email ID.

More over you have to verify whether that senior manager has a right or power to terminate such employees who are acting against the rules and regulation. It is very important because due to some personal enmity the senior manager would take decision with out the consent of the management.

    Dear Aspirant,

To my mind,The senior manager has no power to terminate any employee. The termination power is vested with the appointing authority.Of course the senior manager can terminate the employee after getting the consent of the management. So It is matter of enquiry.Consult the CEO/MD of the company & get clearance of the matter.

Also It does not seem correct to send the email through personal ID for terminating any employee. It will be better to contact the conserned senior manager & enquire of the reality of the mail.

If found false the showcause letter may be issued to the concerned senior manager & disciplinary action may be proceeded against him.

    Thanks.
