    Can a company withhold the salary of an employee because of their irresponsible behavior?

    I am the manager of a company. Some of my employees are not submitting time sheets or submitting time sheets late. Can we legally withhold the salary of employees for not submitting time sheets in time? What are the important suggestions on that?

    Dear Aspirant,

    In practical these types of problems are very common.Withholding salary is the action which may cause irritaion among the employees.First of all issue a memo to those employees giving them time to submit the time sheets & informing them to withhold their salaries if they don't submit the time sheets in the given time.See the result.If you are not satisfied with the result,get approval of your superior to withhold their salary.If you get approval of your superior,the concerned employees can not get easy relief from your superior & also it will be safeguard to you.

    Hi..I dont think you should try to withhold the salary of your employees even if they are not submitting their work on time..You should certainly take strict action against them and not let them go spot free..They should certainly realise their mistakes and not be so irresponsible..

    Firstly you should call all such employees to your office and warn them of their wrongdoings and to try to improve them soon..Then wait for sometime and see if they improve themselves..Those who do you can leave them without giving any punishment..

    But those who dont should be certainly punished for their irresponsibilty and highly carefree attitude..You should either give them a demotion or reduce their salary depending upon your company's policies..Then they will certainly realize their mistake and work harder to regain their positions..This will certainly give them a good lesson..

    No,Indian govt will not allow you to take such actions.You cannot withhold their salary as their whole family depend of them.Instead of this you can warn them that this is the last chance else you may have to leave the company for your irresponsibility.If you want to work continuously with us then you have to work on time and submit all required documents in time.As such there is no rule to withhold salary ,they may go to court against you .Recruit new candidates instead of these lazy people..

    It is sad to hear that your employees are not doing their duty on time.Legally,you cannot withhold the salary of the employees.Instead you can take few steps to stop this kind of irregularities.Here are few suggestions:1.First sit with all those employees and do discussion on this.2.Ask the the reasons and try to understand their mind setup.3.Try to convey them the problems you are facing because of their irregularity.4.Convey them what you expect and want from them.Then observe them for few days.If the same problem persists give them a warning of reporting the higher authorities.Then you report the higher authorities.After that do as the higher authorities direct you.

    Yes my friend they can do so.

    They can deduct a part of your salary as FINE.
    It depends on the level of irresponsible behavior that you have shown to the company.

    If the company feels that because of your laziness,they have suffered a major loss,then they can charge you more FINE!

    Dear friend This is not possible legally so you can not withhold the salary of the employees who are not performing well or doing the work late.. you can do one thing that is to warn that if they do not perform well then they will not be given the salary.. You can discuss with them the problems that they are going with.. Also give them bonus on the completion of the work in time..That will encourage them to work timely.. ALL THE BEST

    With holding the salary should be the last option and you have many steps to take before reaching that.
    First try to maintain a strict environment for the employees when disciplinary actions are taken to irresponsible employees it sets an example to other employees too.
    You can come up with an explaination call for those defaulting employees and when you talk with them in person make them realize how effective the consequences would be for them.
    warn and correct them let them know the punishment and give them some time to correct themselves. If it doesn't work propose a certain amount of fine to the defaulters this could be effective too.
    If everything else fails move to the last option but do it with proper authority.

    Inability to meet deadlines is one of the major problems being faced by the employees and the employers these days. In such a situation witholding the salary of the employees can have both have both pros and cons. It can lead to dissatisfaction among the employees because considering the economic crisis and the condition of inflation these days each and every employee expects to get his salary on a fixed date. It can also cause them to rebel against the company and serious situations like a strike can arise.

    On the other hand if prior notice is served to the employees that meeting their deadlines is very important then they can buckle themselves up and work enthusiastically towards completing the work in hand in a tsipulated time frame. Their salary can be a motivation for them and can help them put their best foot forward. In such situations even calling meetings and discussing the value of time can prove to be helpful. Its always important to make the employees realize the importance of time and correct them whne the time is right.

    Hi friend..

    I think irresponsibility is surely not to be tolerated especially at your workplace from where you earn your living..I think such employees should realise that this company is giving them their bread and butter so how can they even think of doing such a thing as this..

    To teach them a lesson i think you can certainly do something which will make them realise their mistakes and thus not repeat it in future..

    First of all i think you should warn them beforehand of what they are doing and give them some time to improve..If they dont listen to you you can certainly withhold their salary and if they try to complaimt against you instead of improving themselves then i dont think they deserve a place in your company..So you pay them their pending salaries and give them their termination letters..I dont think there is anything illegal about withholding someone's salary if they are not performing their tasks properly..

    Not doing work on time is not being tolerated in the corporate sector. Withholding the salary should be a last action if another action doesn't works. If you withhold the salary, level of indiscipline increases in the company. Firstly you must call all the employees, as an instructions pass them an warning that if in future if work is not executed in time by any employee, a strict action will be taken against them. If any employee even after warning repeats the same then you must have to demote that employee from the position as you have a valid person. If the same continues, at last step is termination of that employee from the company.

    Dear..

    Holding the salary is never an option as it will make them irritate and they can even stop performing well to protest. If you really want to overcome this situation then first of all circulate a circular that now on wards the person who is not submitting the sheets on time will not get salary on time. This will make them aware and they will avoid these kinda mistake. If you really wanna do better then you can arrange a meeting and tell then the problem that the company is facing due to this and also tell them that if it is happening again then the company will stop the salary.

    I am sure this will help you but stopping a salary should be your last option and try other effective method first as stopping salary does not sound legal.
