    Can a company ask to leave a job if employee found with no final degree of his last education?

    To our operational vacancy a candidate with a graduation degree with basic computer knowledge was hired. But in recent audit it was found that the candidate has not completed his last year of degree as he failed in 3 subjects. Now may the employer ask the candidate to leave the job or not?

    Dear first of all you should see that what is the minimum eligibility criteria were kept for that job and position at which he is working well in the office premises means if the eligibility was - Minimum qualification as graduation from a recognized university + Basic Computer Knowledge then there may be a problem with his job because when he has got failed in final year of the degree that means he will not receive the degree from that university until he completes final year again and it would take a long year which would not be accepted by the company so that he should immediately leave the job before the company fire him from the job and if the eligibility criteria for the job were kept - Minimum 12th passed with computer knowledge then he should not leave the job and company may not fire that person and he would be continue on his job and complete the degree

    The employee is in real danger now.This is because in a way he has cheated the company either by supressing the fact that he has not cleared his degree and has failed in 3 subjects or by disclosing false facts regarding his degree.This employee has done something very illegal.Now since the true facts have come across the company,company can do anything against him.As per my assumption,he will be asked to leave,and in extreme case,he will be asked to clear of the papers once again.But the later one is realy doubtful!

    Yes a employer may ask the candidate to leave the job.
    Now its totally in hand of him to handle the situation.

    Employer decision based on ---->
    * If employee is devoted towards work then employer may not ask.
    * If employee has a good reputation all around then also employer may not ask to leave.
    * If there is a vacancy and a post is not yet filled then also same case arise.

    It is well known that each & every post in any organisation has to be filled with a candidate having certain qualification.When you hired a candidate with graduation,how the degree was verified at the time of recruitment?The candidate might have produced some fake certificate or he might have given some untaking to submit the degree certificate in certain period.In this case since the candidate was given job,he may be allowed to pass the desired course & submit the certificate as early as possible.Till that time he may be given leave with loss of pay & continuation of Service.

    Since the candidate seems faithfull to the organisation,the above facility may be given.If it is so urgent,his work profile may be managed with some other employee or temporary recruitmeent may be made to new candidate.

    if the company guidelines are not followed by the candidate in recruitment then company has all the rights in telling the employee to leave the job.. but if there are options or an opportunity for the employee within 3-4 months of attending his supplementary examinations and results are also issued in the same month then yes its possible for a company to give chance to clear off the failed subjects and obtain an degree..
    but i thing i want to make it clear that you should have graduation degree for sure its mandatory for company to employee a candidate its a rule and company can't compromise on that issue all the best thank you

    Such employees who misinform the company about their degree should not be entertained at all and should immediately be terminated from their services. Especially if you checked his certificates the time you hired him and now that you have found that they were fake, then he should not be given another chance and immediately terminated from his job for the fraud which he has done with you.but in case you did not check his certificates when you hired him then its your fault and you should find out another solution to this problem.

    Now if it is the candidates fault and he also mentioned the wrong information in his resume then he is the one to be blamed and you should better terminate his services immediately. But if you and the recruiters were careless at the time of hiring him and he did not say anything false, then you should give him another chance. Tell him that first he should complete his degree and then only you will keep him for the job. Till then you can employ someone else on a temporary basis in his place only if he promises you to return. Otherwsie its better that he leaves this job and goes .
