    Am I eligible for OBC certificate as per the last 3 years income of my father?

    My father is working in a public sector and his income during the last 3 years were:
    (1) The gross income Rs. 3,89,100.00 after tax relaxation total income Rs. 2,96,950.00 from 01/04/09 to 31/03/10 (Assessment year 2010-11),
    (2) The gross income Rs. 4,84,064.00 after tax relaxation total income Rs. 3,84,060.00 from 01/04/10 to 31/03/11 (Assessment year 2011-12),
    (3) The gross income Rs.5,77,061.00 after tax relaxation total income Rs 4,77,060.00 from 01/04/11 to 31/03/12 (Assessment year 2012-13),
    I would like to obtain OBC certificate from concern authority. I am unable to get certificate due to the gross incomes were exceeded 4.5 lakhs during the Assessment years 2011-12 and 2012-13. But an Office Memorandum had issued by Department of Personnel &Training on 14th Oct.2008 vide No.36033/3/2004-Estt.(Res.) mentioned that
    (a) Persons having gross annual income of Rs. 4.5 lakh or above on possessing wealth above the exemption limit as prescribed in the Wealth Tax Act for period of three consecutive years.
    My doubt is: It means a person less than 4.5 lakh in any one of the year of last three comes under non creamy layer. Either an average of 4.5 lakhs of 3 years consecutive years or any one of the year.
    My father did not get form no.16 so far for the period from 01/04/12 to 31/03/13 (Assessment year 2013-14).
    I request your kind honour that I may please be advised whether am I eligible for obtaining the OBC certificate or not. The OBC creamy layer income limit has been raised from 4.5 lakh to 6 lakh. This news was published in the news paper. Whether it is true or not. If yes, when will come into force or in the Govt. Gazettes.

    The government has already raised the OBC limit from rs 4.5 lakhs to 6 lakhs per annum
    That means now if you father annual income is less that 6 lakhs per annum you can apply for the OBC Non Creamy Layer certificate
    This rule has been implemented
    Government has already sent a letter with this regards to all the District Headquaters of the Country to the District Commissioners

    So you can apply for the OBC certificate now
